RULES AND REGULATIONS IN ORDER TO PROCURE THE APPROVAL OF THE CITY PLANNING Zoning
COMMISSION, CITY OF BAYTOWN; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED
($200.00) DOLLARS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A
SAVINGS CLAUSE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF ",
BEING ORDINANCE NO. 723, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN
ON THE 23RD DAY OF JULY, 1964, BY AMENDING SECTION 4, PROCEDURE, BY
ELIMINATING THE RIGHT OF A SUBDIVIDER TO POST A BOND GUARANTEEING TO THE
CITY THE COMPLETION OF THE SUBDIVISION; AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown regulates the subdividing and the platting
of land within its corporate limits; and
WHEREAS, the first ordinance governing this subject matter originally was
passed approximately twenty (20) years ago and that such ordinance has been amended
many times; and
WHEREAS, the present ordinance gives the subdivider a right to post a bond
guaranteeing to the City that he shall finally complete such subdivision according
to the terms of such subdivision ordinance and the plans and specifications submitted
by him; and
WHEREAS, it has been brought to the attention of the City Council that
it is most difficult, if not impossible, for this type of bond to be obtained; NOW,
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That henceforth a subdivider shall have preliminary and final
approval of his subdivision and that final approval shall not be given by the

Planning Commission until all of such improvements are actually completed therein
to the satisfaction of the proper City officials. That no bond, cash or other
arrangement shall he permitted guaranteeing such completion.

Section 2: That all t4xe terms and provisions of the said Ordinance No.
723, passed by the City Council of the City of Baytown on the 23rd day of July, 1964,
are hereby continued in full force and effect and any person violating any of the
terms of the ordinance shall be subject to the penalties provided therein.
Section 3: Effective Date: This ordinance shall take effect from and
after ten (10) days from its passage by the City Council. The City Clerk is hereby
directed to give notice hereof by causing the caption of this ordinance to be
published in the official newspaper of the City of Baytown at least twice within
ten (10) days after the passage of this ordinance.
