Ordinance No. 874ORDINANCE NO. 874 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PERMANENT PAVING " IMPROVEMENTS WITHIN THE FOLLOWING DEFINED PORTIONS OF OAK THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO GULF BITULITHIC COMPANY, THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: �ox Section l: That the work of improving Oak from the South line of the Southern Pacific Railroad right -of -way to the North line of Riggs Street; Johnson Street from the East line of Oak Street to the West line of Willow Street; Stowe Street from the West line of Oaklawn Addition to the West line of Yupon Street; Bookertee Street from the West line of Oaklawn Addition to the West line of Yupon Street; Turner Street from the West line of Oakwood Addition to the West line of Yupon Street; Carver Street from the West line of Oakwood Addition to the West line of Yupon Street; Willow Street on the North line of Oakwood Annex No. 2 to the South line of Oakwood Annex No. 2; Yupon Street from the South line of the Southern Pacific Railroad right -of -way to the North line of the Southern Pacific Railroad right -of -way to the North line of the Missouri Pacific Railroad right -of -way, with- in the City of Baytown, Texas, by raising, grading, filling, widening, permanently paving and repaving same, and by the construction, reconstruction, repairing and realigning of concrete curbs and gutters', and by the construction of such drains and other necessary incidentals and appurtenances as deemed necessary by the City Engineer, said permanent paving consisting of reinforced concrete pavement upon a properly prepared subgrade, of such type, construction, materials and thickness as deemed adequate and suitable by the City Engineer, and all ofsaid improvements being as providing for in the Plans and Specifications therefor which have heretofore been prepared by the City Engineer and as have been approved and adopted by the City Council; and all of same having been performed and completed in full accordance with all the terms and provisions of the contract dated March 24, 1966, between said City of Baytown, Texas, and Gulf Bitulithic Company, and said City Engineer having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of said contract and the Plans and Specifica- tions, and having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said Plans and Specifications, and said City Engineer having approved and accepted said work and improvements and hav:Lng heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommended that it accept and receive said work and the improvements as constructed and completed by said Gulf Bitulithic Company, and said work and improvements having been examined and found by the Mayor and City Council of the said City of Baytown, Texas, to have been performed and completed in full compliance with said contract and said Plans and Specifications therefor, and same are hereby accepted and received by said City Council of the City of Baytown, Texas. Section 2: That the Mayor and City Clerk of the City of Baytown, Texas, are hereby authorized and directed to execute and issue to Gulf Bitulithic Company, Special Assessment Certificates evidencing the assessments levied against the properties improved abutting upon said portions of Oak Street and against the real and true owners thereof, which, by the terms of said contract, the City of Baytown, Texas, has agreed and obligated itself to issue and deliver to said Gulf Bitulithic Company, in accordance with provisions of the relative proceedings heretofore had and adopted by said City Council; said Special Assessment Certificates to be executed in the name of said City by its Mayor and City Clerk, and impressed with the seal of said City, and dated as of the date hereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said City, and deliver same to said Gulf Bitulithic Company, said Special Assessment Certificate having heretofore been prepared and printed, a copy of which is on file with the City Clerk, the form and contents thereof being hereby approved and adopted. Section 3: This ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown.
