ORDINANCE NO. 8
OF THE CITY OF BAYTOWN, TEXAS, CANCELLING THE
HEARING ON BENEFITS INCIDENT TO THE IMPROVE-
MENT OF COMMERCE STREET, SAID HEARING HAVING
BEEN SCHEDULED FOR MAY 25, 1967; ORDERING
THAT IN LIEU OF SAID ORIGINALLY SCHEDULED
HEARING, A HEARING BE HELD AND GIVEN ON
JUNE 22, 1967; SETTING AND FIXING THE TIME
AND PLACE OF SAID RESCHEDULED HEARING AND
DIRECTING THAT NOTICE THEREOF BE GIVEN; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of Baytown, Texas,
on April 27, 1967, enacted its Ordinance No. 862 by which, among
other things, it called for a hearing to be given to the real
and true owners of properties abutting upon Commerce Street
within said City from the South line of Forrest Street to the
North line of Gulf Street as to assessments to be levied against
said properties and the real and true owners thereof incident
to the improvement of said street, said hearing having been
scheduled before said City Council of the City of Baytown in its
Council Chambers in the City Hall in Baytown, Texas, at 6:30
o'clock P.M. on the 25th day of May, 1967; and
WHEREAS, it has been determined by said City Council that
it is impractical to hold said hearing on the date and at the time
scheduled and that said hearing should be cancelled and rescheduled
for a subsequent date; NOW, THEREFORE:
TEXAS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
Section 1: That said hearing as scheduled for May 25, 1967,
at 6 :30 o'clock P.M. is hereby cancelled.
Section 2: That in lieu of said hearing scheduled for May
25, 1967, at 6:30 o'clock P.M., a hearing shall be held and given
to the real and true owners and to all owning or claiming any
interest in any property abutting upon the said Commerce Street
within the limits above defined and to all others owning or
claiming any interest in said property or any of said matters as

to the assessments and as to the amount to be assessed against
each parcel of abutting property and the real and true owners
thereof and as to the special benefits to said property to be
received from said improvements, or considering any error, in-
validity, irregularity or deficiency in any proceedings or the
contract with reference thereto or concerning any matter or
thing connected therewith, which hearing shall be held by the
City Council of the City of Baytown, Texas, in its Council
Chambers at the City Hall in Baytown, Texas, at
o'clock P.M. on the 22nd day of June, 1967, at which time and
place all persons, firms, corporations or estates owning or
claiming any such abutting property or interest therein and
their agents or attorneys or persons interested in said pro-
ceedings shall be notified to appear and to be heard in person
or by counsel and may offer evidence; and said hearing may be
adjourned from day to day and from time to time and kept open
until all evidence and protests have been duly offered and
heard; and the City Clerk is hereby directed to give notice of
said hearing by advertisement thereof inserted at least three
(3) times in some newspaper published in the City of Baytown,
Texas, the first publication of such notice of hearing to be
made at least twenty -one (21) days before the date of the hearing;
and, additional written notice of the hearing shall be given by
depositing in the United States mail, at least fourteen (14) days
before the date of the hearing, postage prepaid, in an envelope
addressed to the owners of the respective properties as their
names are shown on the then current rendered tax rolls of such
City and at the address so shown, or if the names of such re-
spective owners do not appear on such tax rolls, then addressed
to such owners as their names are shown on the then current un-
rendered tax rolls of the City at the address as shown thereon.
Effective Date: That this ordinance shall take effect from
and after the date of its passage by a majority of its City Council
