Ordinance No. 858ORDINANCE NO. X58 AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF STATE HIGHWAY NO. 146 WITHIN THE CITY LIMITS OF BAYTOWN, TEXAS; RE- PEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS AND PRO- VIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. WHEREAS, the Texas Highway Department has made it known to the City of Baytown that operations will begin in the near future for the second stage development of State Highway No. 146 from three quarters mile East of Lee Drive to 1.0 mile East of Lee Drive; and WHEREAS, in the interest of safety, it is desirable to maintain a Construction Speed Zone during the construction period, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a Construction Speed Zone be established along State Highway No. 146 from a point 3960 feet East of Lee Drive to a point 5280 feet East of Lee Drive, a distance of approximately 0.246 mile long, 30 miles per hour when so signed within said zone. Section 2: Necessary signs for posting the Speed Zone will be furnished, installed and maintained by direction of the Texas Highway Department's Engineer in charge of the project. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the sub- ject matter covered by this ordinance. Section 4: If any provision, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not effect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: Any person, firm, or corporation violating any provision of this ordinance or failing to observe any provision hereof, shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in any sum not to exceed Two Hundred ($200.00) Dollars, and each and every day or fraction thereof, which I this ordinance, or any part thereof, shall be violated, shall be deemed a separate offense and punishable as such. Section 6: This ordinance shall be in effect only during the period of construction, when the roadways or portions of roadway are so signed, and completion of the project shall automatically cancel the Speed Zone. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice prior to the construction period.
