TEXAS; REPEALING OIRDINANCES INCONSISTENT HEREWITH; CONTAINING A. SAVINGS CLAUSE; PROVIDING FOR A PENALTY AND THE EFFECTIVE DATE THERE - OF." BEING ORDINANCE NO. 637, PASSED BY THE CITY COUNCIL OF THE CITY, OF BAYTOWN ON THE 12TH DAY OF NOVEMBER, 1964, BY ADDING PARAGRAPHS`�(e), f) AND (f6 TO SECTION FIVE (3); AND, BY ADDING PARAGRAPHS 5, 6 AND 7 TO SECTION THIRTY -ONE (31) THERETO, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTO141i, TEXAS: A r tB Section 11: That paragraphs (te), Q) and {gj she'll be added to Section 5 and shz ,Al read as fellows, to -wit: (e). Conditions of the Permit: The Building Official shall act upon an appli- cation for a permit with plans as filed, or as amended, withoutAi"sonable or un- necessary delay. A permit shall be construed to be a license to proceed with the work and shall not be construed as authority to violate, cancel, alter, or set aside any of the provisions of this code, nor shall such issuance or a permit prevent the Building Official from thereafter requiring a correction of errors in plans or in construction, or of violations of this code. Any permit issued shall become invalid unless the stark authorized by it shall have been commenced within six months after its issuance, or if the work authorized by such permit is suspended or abandoned for R period of one year after the time the work is commenced; provided, that, for cause, one or more extensions of time, for periods not exceeding ninety days each, may be aallo,;e3 in .writing by the Building Official. (f). Drawings to be kept at _stte: 4,dhen the Building Official issues a permit, he shall endorse, in writing, or stamp, both sets of plans ",APPROVED ". One set cf drawings so approved shall be retained by the Building Official and the other set shall be returned to the applicant. The approved drawings shrill be kept at the site of work and shall be open to inspection by the Building Official or his autho- rized representative. Action on Application: (i) No person, firm or corporation shall erect, construct, enlarge, Alter, Aspok , move, improve, remove, convert or demolish any building or structure in the applicable jurisdiction, or cause the same to be done, without first obtaining a separate building permit for such buildings or structures from the Building Officio ". (ii) If the Building Official is satisfied that the work described in an application for permit and the drawings filed therewith conform to the requirements of this code and rather pertinent laws and ordinances, he shall issue a permit there- for to the applicant. (i7A) If the application for a permit and the drawings filed therewith describe work which does not conform to the requirements of this coda or other per- tinent laws or ordinances, the Building Official shall not issue as permit, but ,,hall return the dral,,ings to the applicant with his refusal to issue such permit.
