AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN APPOINTING THE
BAYTOWN PLANNING COMMISSION AS THE ZONING COMMISSION OF SAID CITY; PRO-
VIDING A SAVINGS CLAUSE, PROVIDING FOR A REPEALING CLAUSE; AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of Baytown duly created a Planning
Commission on September 6, 1963, by Ordinance No. 702; and
WHEREAS, the City Council, the Administration, the Planning Commission
and others have spent considerable time in an effort to establish zoning in
Baytown; and
WHEREAS, under the law, when a City decides to avail itself of the
powers conferred by the statutes of this State concerning zoning it must, among
other things, appoint the Planning Commission as a Zoning Commission; NOW THERE-
FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Planning Commission for the City of Baytown hereto-
fore created on September 6, 1963, by Ordinance No. 702, is hereby appointed,
authorized and established as the Zoning Commission for Baytown. That said body
is hereby established with and given all the powers provided by law. That the
paramount interest of the City Council is to properly appoint and empower this
body to properly formulate and make functional zoning in Baytown.
Section 2: Savings Clause. In the event any section, subsection, sen-
tence, clause or phrase of this ordinance shall be declared or adjudged invalid
or unconstitutional, such adjudication shall in no means affect any other section,
subsection, sentence, clause, or phrase of this ordinance, but all the rest there-
of shall be in full force and effect just as though the section, subsection, sen-
tence, clause or phrase so declared or adjudged invalid or unconstitutional was
not originally a part thereof.
Section-3: Repealing Clause. All ordinances or parts of ordinances incon-
sistent with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency, and in all
other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.

Section 4: Effective Date. This ordinance shall take effect from and
after ten (10) days from its passage by the City Council. The City Clerk is
hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice
within ten (10) days after the passage of this ordinance.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the
City Council of the City of Baytown on this the 12th day of January, A. D., 1967.
