Ordinance No. 846ORDINANCE NO. 84,6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN MAKING IT UNLAWFUL FOR ANY PERSON, PARTNERSHIP, ASSOCIATION, CORPORATION OR OTHER ENTITY TO OPERATE A COMMUNITY, INCLUDING ANY OTHER COMMUNICA- TION SYSTEM SUCH AS PHONOSCOPE, UNLESS SUCH PERSON, PARTNERSHIP, ASSOCIATION, CORPORATION OR OTHER ENTITY HAS A FRANCHISE FROM THE CITY OF RAYTOWN AUTHORIZING SUCH OPERATION; PROVIDING A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A PENALTY CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RAYTOWN: Section 1: That it shall be unlawful for any person, partnership, association, corporation or other entity to operate a community antenna tele- vision system, including any other communication system such as Phonoscope, unless such person, partnership, association, corporation or other entity has been franchised by the City of Baytown to operate such community antenna television system. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordi- nances governing and regulating the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the ap- plication of same to any person or set of circumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 4: Penalty Clause: Any person, partnership, association, corporation or other entity violating the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not less than $10.00 and not more than $200.00, Section 5: Effective Date: This ordinance shall take affect from and after ten (10) days from its passage by the City Council. The City Clerk is her6by directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
