Ordinance No. 838-AORDINANCE NO. 838 -A AN ORDINANCE CONTAINING ORDINANCE NO. 838, INTRODUCED THE 27TH DAY OF OCTOBER, 1966, AND BEING, "AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXA- TION OF CERTAIN TERRITORY CONSISTING OF 4.8 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS." PROVIDING FOR THE FINAL PASSAGE OF SAID ORDINANCE PURSUANT TO ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That pursuant to Article I, Section 9, of the City Charter, said Ordinance No. 838, introduced to the City Council of the City of Baytown, on the 27th day of October, 1966, in its original form shall read as follows: ORDINANCE NO. 838 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 4.8 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property, to -wit: TRACT ONE BEGINNING at a point on the existing City limit line of the City of Baytown, said point being more fully described as a point on the South right -of -way line of State F. M. Highway 1942 at a distance of 17,530 feet West of the intersection of the Easterly right -of -way line of the Southern Pacific Railroad and the South right -of -way line of State F. M. Highway 1942; THENCE, in a Westerly direction along the South right -of -way line of State F.M. Highway 1942 approximately 7,800 feet to a point for corner; THENCE, in a Northwesterly direction along the Southwest right -of -way line of State F. M. Highway 1942 approximately 2,760 feet to a point for corner; THENCE, in a Northeast direction a distance of ten feet to a point for corner, the ten feet being measured perpendicular to the Southwest right -of -way line of State F. M. Highway 1942; THENCE, in a Southeasterly direction, ten feet from and parallel to the Southwest right -of -way line of State F. M. Highway 1942, approximately 2,756 feet to a point for corner; THENCE, in an Easterly direction, ten feet from and parallel to the South right -of -way line of State F. M. Highway 1942, approximately 7,796 feet to a point for corner on the existing City limit line of the City of Baytown; THENCE, in a Southerly direction, a distance of ten feet along the existing City limit line of the City of Baytown to the POINT OF BEGINNING. TRACT TWO BEGINNING at a point on the existing City limit line of the City of Baytown, said point being more fully described as a point on the East right -of -way line of the Bohemian Hall Road at a distance. 21,120 feet South of the inter- section of the South right -of -way line of U. S. Highway No. 90 and the East right -of -way line of the Bohemian Hall Road; THENCE, in a Southerly direction along the East right -of -way line of Bohemian Hall Road approximately 900 feet to the intersection of Bohemian Hall Road and State F. M. Highway 1942, also known as the Crosby -Cedar Bayou Road, then continuing on the same course across State F. M. Highway 1942 to a point which is ten feet perpendicularly from the Southwest right -of -way line of State F. M. Highway 1942; THENCE, in a Southeasterly direction, ten feet from and parallel to the Southwest right -of -way line of State F. M. Highway 1942 a distance of approxi- mately 9,510 feet to a point for corner; THENCE, in a Southwesterly direction, perpendicular to the Southwest right - of -way line of State F. M. Highway 1942, a distance of ten feet to a point for corner on the said Southwest right -of -way line of State F. M. Highway 1942; THENCE, in a Northwesterly direction along the Southwest right -of -way line of State F. M. Highway 1942, a distance of approximately 9,524 feet to a point for corner which is ten feet West of the East right -of -way line of Bohemian Hall Road as projected across State F. M. Highway 1942; THENCE, in a Northerly direction, ten feet from and parallel to the East right -of -way line of Bohemian Hall Road, a distance of approximately 1,036 feet to a point for corner on the existing City limit line of the City of Baytown; THENCE, in an Easterly direction a distance of ten feet along the existing City limit line of the City of Baytown to the POINT OF BEGINNINC. was held at 6 :30 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 13th day of October, 1966, which date is not more than twenty days nor less than ten days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, andin the above described territory on the 26th day of September, 1966, which date is not more than twenty nor less than ten days prior to the date of such public hearing; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the first day of January, 1966, was 15,169.85 acres; and WHEREAS, the population of the City of Baytown, Texas, is 34,423 inhabitants; and WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and •WHEREAS, the above described territory lies adjacent to andadjoins the City of Baytown, Texas; and WHEREAS, the above described territory contains 4.8 acres; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The following described land and territory lying adjacent to and adjoining the City of Baytown, Texas, is hereby added and annexed to the City of Baytown, Texas, and the said territory hereinafter described shall here- after be included within the boundary limits of the City of Baytown, Texas, and the present boundary limits of such City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: TRACT ONE Beginning at a point on the existing City limit line of the City of Baytown, said point being more fully described as a point on the South right -of -way line of State F. Highway 1942; THENCE, in a Northerly direction, ten feet from and parallel to the East right -d -way line of Bohemian Hall. Road, a distance of approximately 1,036 feet to a point for corner on the existing City limit line of the City of Baytown; THENCE, in an Easterly direction a distance of ten feet along the existing City limit line of the City of Baytown to the POINT OF BEGINNING. Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Baytown, Texas. Section 3: This ordinance shall be published and passed in the manner provided in Article 1, Section 9 of the Charter of the City of Baytown, Texas.
