Ordinance No. 844ORDINANCE NO. 844 AN ORDINANCE AMENDING AN ORDINANCE, "AN ORDINANCE PROVIDING FOR FIRE LIMITS, AND REGULATIONS GOVERNING THE CONSTRUCTION, ALTERATION, EQUIP- MENT AND REMOVAL OF BUILDINGS AND STRUCTURES WITHIN THE CITY LIMITS OF BAYTOWN, TEXAS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY AND THE EFFECTIVE DATE THERE- OF." BEING ORDINANCE NO. 637, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 12TH DAY OF NOVEMBER, 1964, BY ADDING PARAGRAPH FIVE (5) THERETO, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Paragraph 5 shall be added to Section 2 and shall read as follows: (5) In all subdivisions started after November 12, 1964, sidewalks shall be erected on the front and street side of each lot therein and said sidewalks shall be at least four feet (4') in width, four inches (4 ") in depth, constructed of four and one -half (42) sack, rock aggregate Portland cement concrete, and shall be placed in the street easement parallel to and adjacent to the property lines of said lots. Such sidewalks shall be installed in all of such subdivisions before the City Building Inspector grants final approval to any affected building or within two (2) years of the final approval of such sub- division, whichever first occurs. Non- compliance within such two (2) year period shall subject the property owner at that time to an assess- ment, according to law, by the City for the cost of the sidewalk. Section 2: That all the terms and provisions of the said Ordinance No. 637, passed by the City Council of the City of Baytown on the 12th day of November, 1964, are hereby continued in full force and effect and any person violating any of the terms of the ordinance shall be subject to the penalties provided therein. Section 3: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice prior to the effective date thereof.
