Ordinance No. 805ORDINANCE NO. 805 AN ORDINANCE APPROPRIATING THE SUM OF $33,655.43 OUT OF THE CAPITAL IMPROVEMENTS, STREET FUND, SERIES 1965, TO PAY THE COST OF CURBS, GUTTERS, AND PAVING TO BE CONSTRUCTED BY GULF BITULITHIC COMPANY IN FRONT OF CERTAIN PARCELS OF PROPERTY ABUTTING UPON OAK STREET FROM THE SOUTH LINE OF THE SOUTHERN PACIFIC RAILROAD RIGHT -OF -WAY TO THE NORTH LINE OF RIGGS STREET; JOHNSON STREET FROM THE EAST LINE OF OAK STREET TO THE WEST LINE OF WILLOW STREET; STOWE STREET FROM THE WEST LINE OF OAKLAWN ADDITION TO THE WEST LINE OF YUPON STREET; BOOKERTEE STREET FROM THE WEST LINE OF OAKIAWN ADDITION TO THE WEST LINE OF YUPON STREET; TURNER STREET FROM THE WEST LINE OF OAKWOOD ADDITION TO THE WEST LINE OF YUPON STREET; CARVER STREET FROM THE WEST LINE OF OAKWOOD ADDITION TO THE WEST LINE OF YUPON STREET; WILLOW STREET ON THE NORTH LINE OF OAKWOOD ANNEX NO. 2 TO THE SOUTH LINE OF OAKWOOD ANNEX NO. 2; YUPON STREET FROM THE SOUTH LINE OF THE SOUTHERN PACIFIC RAILROAD RIGHT - OF -WAY TO THE NORTH LINE OF THE MISSOURI PACIFIC RAILROAD RIGHT -OF -WAY, IN THE CITY OF BAYTOWN, TEXAS, WHICH PARCELS OF PROPERTY APPEAR TO BE EXEMPT FROM ASSESSMENTS BY GULF BITULITHIC COMPANY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the Director of Finance has certified to the City Council that there is in his hands in the above fund, available for appropriation, a sum sufficient for the purpose herein below stated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: There is hereby appropriated out of the Capital Improvements, Street Fund, Series 1965, the sum of $33,655.43 to pay the cost of curbs, gutters and paving to be constructed by Gulf Bitulithic Company under a contract dated March 24, 1966, between said Company and the City of Baytown in front of the following parcels of property abutting upon Oak Street from the South line of the Southern Pacific Railroad right -of -way to the North line of Riggs Street; Johnson Street from the East line of Oak Street to the West line of Willow Street; Stowe Street from the West line of Oaklawn Addition to the West line of Yupon Street; Bookertee Street from the West line of Oaklawn Addition to the West line of Yupon Street; Turner Street from the West line of Oakwood Addition to the West line of Yupon Street; Carver Street from the West line of Oakwood Addition to the West line of Yupon Street; Willow Street on the North line of Oakwood Annex No. 2 to the South line of Oakwood Annex No. 2; Yupon Street from the South line of the Southern Pacific Railroad right -of -way to the North line of the Missouri Pacific Railroad right -o£ -way, in the City of Baytown, Texas, taking from Gulf Bitulithic Company an assignment, without recourse, of the paving certificates evidencing said assessments, said parcels of property appear to be exempt from assessments by the Contractor for such improvements and to be owned by parties who have failed or refused to secure the City's contractor in the payment of the assessments levied in connection with said improvements, namely: OWNER WILLOW AVENUE 1. Said fund is the lawful and proper fund out of which this appropria- tion can be paid, and this appropriation is made pursuant to a proper certificate of the Director of Finance. Section 2: This Ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown.
