Ordinance No. 789ORDINANCE NO. 789 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 4.84 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described territory; TRACT ONE BEGINNING at a point on the existing City limits line of the City of Baytown, said point being more fully described as being on the South right -of -way line, a distance of 10,560 feet Easterly from the inter- section of the South right -of -way line of State Highway No. 73 (Interstate Highway No. 10) and the centerline of Cedar Bayou Stream; THENCE, in an Easterly direction along the South right -of -way line of State Highway No. 73, a distance of 1320 feet, plus or minus, to a point at the intersection of the South right -of -way line of State High- way No. 73, and the West right -of -way line of Farm Market Road; said Farm Market Road being an extension of Farm Market Road No. 2354 from Farm Market Road No. 565 to State Highway No. 73; THENCE, in a Southerly direction along the West right -of -way line of said Farm Market Road, a distance of 9240 feet to a point for corner; THENCE, in an Easterly direction perpendicular to the West right -of- way line of aforesaid Farm Market Road, a distance of 10 feet to a point for corner; THENCE, in a Northerly direction 10 feet from and parallel to the West right -of -way line of the aforesaid Farm Market Road, a distance of 9250 feet to a point 10 feet North of the South right -of -way line of State Highway No. 73; THENCE, in a Westerly direction 10 feet from and parallel to the South right -of -way line of State Highway No. 73, a distance of 1330 feet, plus or minus, to a point on the existing City limit line; THENCE, in a Southerly direction along the existing City limit line, a distance of 10 feet to the POINT OF BEGINNING. TRACT TWO BEGINNING at a point on the existing City limit line of the City of Baytown, said point being more fully described as a point on the North right -of -way line of the Tri -City Beach Road, a distance of 10,560 feet in a Southeasterly direction from the point where the mean high tide line of the Westerly shoreline of Ash Lake intersects with the North- easterly right -of -way line of Tri -City Beach Road; THENCE, along the North right -of -way of the Tri -City Beach Road, a distance of one foot to a point; THENCE, in a Southerly direction, perpendicular to the North right -of- way line of Tri -City Beach Road, to a point 10 feet from the South right -of -way line of Tri -City Beach Road; THENCE, in an Easterly and a Northeasterly direction 10 feet from and parallel to the South and the Southeasterly right -of -way line of the Tri -City Beach Road, a distance of 10,500 feet to a point; �,, r� THENCE, in a Southeasterly direction, perpendicular to the Southeast- erly right -of -way line of the Tri -City Beach Road, a distance of 10 feet to a point on the said Southeasterly right -of -way line of Tri -City Beach Road; THENCE, in a Southwesterly and a Westerly direction along the Southeast- erly and the South right -of -way line of the Tri -City Beach Road a distance of 10,500 feet to a point; 5U 1 THENCE, in a Northerly direction, perpendicular to the South right -of -way line of the Tri -City Beach Road a distance of approximately 60 feet to the POINT OF BEGINNING. BEING a strip of land one foot wide crossing from the North right -of -way line to the South right -of -way line of Tri -City Beach Road and a ten foot wide strip of land with a length of two miles along the South right -of -way line of Tri -City Beach Road. was held at 6 :30 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 18th day of March, 1966, which date is not more than twenty days nor less than ten days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, and in the above described territory on the 7th day of March, 1966, which date is not more than twenty nor less than ten days prior to the date of such public hearing; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the first day of January, 1966, was 15,169.85 acres; and WHEREAS, the population of the City of Baytown, Texas, is 38,423 inhabitants; and WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the above described territory lies adjacent to and ajoins the City of Baytown, Texas; and WHEREAS, the above described territory contains 4.84 acres; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The following described land and territory lying adjacent to and adjoining the City of Baytown, Texas, is hereby added and annexed to the City of Baytown, Texas, and the said territory hereinafter described shall hereafter be included within the boundary limits of the City of Baytown, Texas, and the present boundary limits of such City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: TRACT ONE BEGINNING at a point on the existing City Limits Line of the City of Baytown, said point being more fully described as being on the South right -of -way line, a distance of 10,560 feet Easterly from the inter- section of the South right -of -way line of State Highway No. 73 (Interstate Highway No. 10) and the centerline of Cedar Bayou Stream; THENCE, in an Easterly direction along the South right -of -way line of State Highway No. 73, a distance of 1320 feet, plus or minus, to a point at the intersection of the South right -of -way line of State High- way No. 73, and the West right -of -way line of Farm Market Road; said Farm Market Road being an extension of Farm Market Road No. 2354 from Farm Market Road No. 565 to State Highway No. 73; THENCE, im a Southerly direction along the West right -of -way line of said Farm Market Road, a distance of 9240 feet to a point for corner; THENCE, in an Easterly direction perpendicular to the West right -of- way line of aforesaid Farm Market Road, a distance of 10 feet to a point for corner; THENCE, in a Northerly direction 10 feet from and parallel to the West right -of -way line of the aforesaid Farm Market Road, a distance of 9250 feet to a point 10 feet North of the South right -of -way line of State Highway No. 73; THENCE, in a Westerly direction 10 feet from and parallel to the South right -of -way line of State Highway No. 73, a distance of 1330 feet, plus or minus, to a point on the existing City limit line; THENCE, in a Southerly direction along the existing City limit line, a distance of 10 feet to the POINT OF BEGINNING, TRACT TWO BEGINNING at a point on the existing City limit line of the City of Baytown, said point being more fully described as a point on the North right -of -way line of the Tri -City Beach Road, a distance of 10,560 feet in a Southeasterly direction from the point where the mean high tide line of the Westerly shoreline of Ash Lake intersects with the North- easterly right -of -way line of Tri -City Beach Road; THENCE, along the North right -of -way of the Tri -City Beach Road, a distance of one foot to a point; THENCE, in a Southerly direction, perpendicular to the North right -of- way line of Tri -City Beach Road, to a point 10 feet from the South right -of -way line of Tri -City Beach Road; THENCE, in an Easterly and a Northeasterly direction 10 feet from and parallel to the South and the Southeasterly right -of -way line of the Tri -City Beach Road, a distance of 10,5061 feet to a point; THENCE, in a Southeasterly direction, perpendicular to the Southeas- erly right -of -way line of the Tri -City Beach Road, a distance of 10 feet to a point on the said Southeasterly right -of -way line of Tri -City Beach Road; THENCE, in a Southwesterly and a Westerly direction along the Southeast- erly and the South right -of -way line of the Tri -City Beach Road a distance of 10,59d feet to a point; Sr 1 0 THENCE, in a Northerly direction, perpendicular to the South right -of -way line of the Tri -City Beach Road a distance of approximately 60 feet to the POINT OF BEGINNING. Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Baytown, Texas. Section 3: This ordinance shall be published and passed in the manner provided in Article 1, Section 9 of the Charter of the City of Baytown, Texas.
