Ordinance No. 771ORDINANCE NO. �') AN ORDINANCE EST;=.BLISHIWG SPEED LIJiITS DURING CONSTRUCTION ON r� PORTION OF SPUR 330 '.JITHIN THE CITY LIi:iITS OF BAYTO.JN, TEXAS, R PEALING CiRDINANCES INCONSISTENT HEREUITH; CONTAINING A SAVINGS CLAUSE; P RESCRIBI14G i.:r,Xli:iUi.i PZ:Nf.L- TY OF TCJU HUNDRED (.;200.00) DOLLARS AND PRO- VIDING FOR THE PUBLICATION i-IWD EFFECTIVE DATz THEREOF . l'JHRL.a�, the Texas Highway Department has made it known to the City of Baytown that operations will begin in the near future for the improvement of Spur 330 from Baytown Jest City Limit at Spring Gully to a point 1,000 feet `West of Bayway Drive; and JHEREAS, in the interest of safety, it is desirable to main- tain a Construction Speed Zone during the construction period; NOIJ, THrEREFORE, B� IT ORDAINED BY THE CITY COUNCIL OF THL CITY OF Bi,YTG..2l: Section 1: That a Construction Speed Zone be established along Spur 330 from Baytown .Jest City Limit to a point 1,000 feet '.lest of Bayway Drive, a distance of approximately 0.539 mile, 30 miles per hour when so signed within said Zone. Section 2: Necessary signs for posting the Speed Zone will be furnished, installed and maintained by direction of the Texas Highway Department's engineer in charge of the project. Section 3: All ordinances or parts of ordinances inconsis- tent with the terms of this ordinance are hereby repealed; pro- vided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cum- ulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 5: i,ny person, firm or corporation violating any pro- vision of this ordinance or failing to observe any provision hereof, shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in any sum not to exceed Two Hundred (.;200.00} Dollars, and each and every day or fraction thereof, which this ordinance or any part thereof shall be violated shall be deemed a separate of- fense and punishable-as such. Section b:' This ordinance shall take effect from and after ten (10 ) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten days after the passage of this ordinance. This ordinance shall be in effect only during the period of construction, and completion of the project shall auto- matically cancel the Speed Zone.
