Ordinance No. 768ORDINANCE NO. 768 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 122.97 ACRES OF LAND, 1MICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRE - SENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. IMEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were pro- vided with an opportunity to be heard on the proposed annexation of the following described territory: BEGINNING at a point on the existing City of Baytown boundary line, said point being two hundred (2001) feet North of the North right of way line of the Massey -Tbmp- kins Road and two hundred (2001) feet East of the East right of way line of North i.lain Street; THENCE, in a Northerly direction two hundred (2001) feet from and parallel to the East right of way line of North Main Street a distance of three thousand one hundred and twenty -four (3,1241) feet to a point on the projected North right of way line of Baker Road; THENCE, in a Westerly direction along the North right of way line of Baker Road a distance of nine hundred sixty - three (9631) feet to a point; said point being the South- west corner of Sunrise Court Subdivision and the South- east corner of the Goose Creek Independent School District property; THENCE, North 0 degrees 27 minutes East a distance of eight hundred ninety -three and twenty -three hundredths (893.231) feet to a point; THENCE, North 89 degrees 50 minutes East a distance of nine hundred sixty -two (962.01) feet to a point on the `;Jest - erly right of way line of North I:lain Street; THENCE, along said Westerly right of way line of North Main Street North 0 degrees 28 minutes East a distance of sixty (601) feet to a point; THENCE, South 89 degrees 50 minutes hest a distance of nine hundred forty -nine and ninety hundredths (949.90') feet to a point; THENCE, North 0 degrees 04 minutes East a distance of eight hundred ninety -six and sixty hundredths (896.601) feet to a point; THENCE, South 89 degrees 50 minutes w`lest a distance of four hundred ninety (490.0') feet to a point; THENCE, North 0 degrees 04 minutes East a distance of nine hundred and forty hundredths (900.401) feet to a point on the South right of way line of the Cedar Bayou- Lynch- burg Road; THENCE, South 88 degrees 24 minutes West along said South right of way line of the Cedar Bayou - Lynchburg Road a dis- tance of one thousand fifty -two (1.052.01) feet to a point on the West property line of the Goose Creek Independent School District property; said point being the Northwest corner of said school property; THENCE, South 0 degrees 89 minutes 37 seconds East along the 'lest property line of the Goose Creek Independent School District property a distance of two thousand seven hundred twenty -five and six- tenths (2,725.61) feet to a point on the North right of way line of Baker Road; THENCE, in a idesterly direction along the North right of way line of Baker Road to a point of intersection with the centerline of the i:ast Branch of Goose Creek Stream; said point of intersection being a point on the existing City Limit Line of the City of Baytown, was held at 5:00 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 28th day of Decem- ber, 1965, which date is not more than twenty days nor less than ten days prior to the institution of annexation proceedings; and EP EREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, and in the above described territory on the 15th day of December, 1965, which date is not more than twenty nor less than ten days prior to the date of such public hearing; and MEREAS, the total corporate area of the City of Baytown, Texas, on the first day of January, 1965, was 15,046.40 acres; and 1lHEREAS, the population of the City of Baytown, Texas, is 38,423 inhabitants; and IM MEAS, the above described territory lies within the ex- traterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the above described territory lies adjacent to and adjoins the City of Baytown, Texas; and 11HEREAS, the above described territory contains 122.97 acres; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The following described land and territory ly- ing adjacent to and adjoining the City of Baytown, Texas, is here- by added and annexed to the City of Baytown, Texas, and the said territory hereinafter described shall hereafter be included with- in the boundary limits of the City of Baytown, Texas, and the { present boundary limits of such City, at the various points con- tiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: BE-GINNING at a point on the existing City of Baytown boundary line, said point being two hundred (2001) feet North of the North right of way line of the !Massey -Tomp- kins Road and two hundred (2001) feet Last of the Last right of way line of North i lain Street; THLNCE, in a Northerly direction two hundred (2001) feet from and parallel to the Last right of way line of North I,iain Street a distance of three thousand one hundred and twenty -four (3,1241) feet to a point on the projected North right of way line of Baker Road; THENCE, in a I.Jesterly direction along the North right of way line of Baker Road a distance of nine hundred sixty - three (9631) feet to a point; said point being the South- west corner of Sunrise Court Subdivision and the South- east corner of the Goose Creek Independent School District property; THENCE, North 0 degrees 27 eight hundred ninety -three (893.23') feet to a point; minutes Last a distance of and twenty -three hundredths THENCE, North 89 degrees 50 minutes Bast a distance of nine hundred sixty -two (962,01) feet to a point on the .Jest - erly right of way line of North E.iain Street; THLNCL, along said "Jesterly right of way line of North Main Street North 0 degrees 28 minutes Last a distance of sixty (601) feet to a point; THENCL, South 89 degrees 50 minutes 4Iest a distance of nine hundred forty -nine and ninety hundredths (949.901) feet to a point; THirNCE, North 0 degrees 04 minutes Last a distance of eight hundred ninety -six and sixty hundredths (896.601) feet to a point; THENCE, South 89 degrees 50 minutes Nest a distance of four hundred ninety (490.01) feet to a point; THiNCL, North 0 degrees 04 minutes Last a distance of nine hundred and forty hundredths (900.401) feet to a point on the South right of way line of the Cedar Bayou - Lynchburg Road; THENCE, South 88 degrees 24 minutes ':lest along said South right of way line of the Cedar Bayou - Lynchburg Road a dis- tance of one thousand fifty -two (1,052.01) feet to a point on the ;lest property line of the Goose Creek Independent School District property; said point being the Northwest corner of said school property; THENCE, South 0 degrees 89 minutes 37 seconds Last along the '.lest property line of the Goose Creek Independent School District property a distance of two thousand seven hundred twenty -five and six- tenths (2,725.61) feet to a point on the North right of way line of Balser Road; TH04CE, in a "Jesterly direction along the North right of way line of Baker Road to a point of intersection with the centerline of the Last Branch of Goose Creek Stream; said point of intersection being a point on the existing City Limit Line of the City of Baytown. Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the pro- perty so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Baytown, Texas. Section 3: This ordinance shall be published and passed in the manner provided in article I, Section 9 of the Charter of the City of Baytown, Texas.
