AN ORDINANCE PROHIBITING ANY PERSON, OTH.:R
THAN A PEACE OFFICER IN THE DISCHARGE OF
HIS DUTIES, TO DISCHARGE ANY GUN, PISTOL OR
FIREARM, 6"JITHIN THE CITY OF BAYTOWN; PROVID-
ING FOR CERTAIN EXCEPTIONS; REPEALING ORDIN-
ANCES INCONSISTENT THEREWITH; CONTAINING A
SAVINGS CLAUSE; PROVIDING A PENALTY AND THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOtM:
Section 1: It shall be unlawful for any person within the cor-
pprate limits of the City of Baytown to discharge any firearm, except
in the exercise of a right conferred by law, including but not limited
to the making of a lawful arrest, the lawful prevention of crime, the
lawful exercise of the right of self - defense, the lawful protection of
one's family and /or property or in the lawful use of a designated pistol,
shotgun and /or rifle range which is inspected and approved for safety of
design and operation by the Chief of Police and a bona fide member of
the National Rifle Association of America.
Section 2: If any provision, exception, section, subsection,
paragraph, sentence, clause or phrase of this ordinance or the applica-
tion of same to any person or set of circumstances, shall for any reason
be held unconstitutional, void or invalid, such invalidity shall not af-
fect the validity of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to this end
all provisions of this ordinance are declared to be severable.
Section 3: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency and
in all other respects this ordinance shall be cumulative of other ordin-
ances regulating and governing the subject matter covered by this ordin-
ance.
Section 4: Any person who shall violate any provision or pro-
visions of this ordinance shall be guilty of a misdemeanor and, upon
conviction shall be punished by a fine of not more than One Hundred
(y100.00) Dollars. Each day of the continuance of such violation shall

be considered a separate offense.
Section 5: This ordinance shall take effect from and after ten
(10) days after its passage by the City Council. The City Clerk is
hereby directed to give notice hereof by causing the caption of this
ordinance to be published in the official newspaper of the City of Bay-
town at least twice within ten days after its passage.
INTRODUCED, READ and PASSED by the affirmative vote of a majority
of the City Council of the City of Baytown, this the 11th day of Wovem-
ber, 1965.
