ING A PENALTY FOR VIOLATION OF THIS ORDINAACE; PROVIDING A
SAVINGS CLAUSE; REPEALING ALL ORDINANCLS IN CONFLICT WITH
THIS ORDINANCE AND PROVIDING FOR THE PUBLICATION AND EFFECT-
IVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THL CITY OF BAYTOUN:
Section 1: That Section Six (6) of said Ordinance do. 749 shall
be amended as follows:
Section 6: The City shall charge for its services in removing
and disposing of garbage and refuse from houses, buildin s and premises
used for residential purposes the sum of One and 25/100 X1.25) Dollars
per month for each residence, dwelling or apartment from which garbage
is collected. The charge or fee herein fixed for removal and disposal
of garbage shall be and is hereby levied by the City of Baytown against
all owners, occupants, tenants or leasees using or occupying any build-
ing, house or structure receiving such service. It is deemed necessary
that this charge be levied as provided in order to provide and maintain
proper and prompt removal of all refuse and garbage, trash and other
accumulations, such removal being essential to the preservation of
public health and safety. Any person who shall fail or refuse to pay
the charge herein specified within thirty days from the date same shall
become due and payable, shall have his service suspended, and the City
Health Officer shall be notified immediately for appropriate action in
accordance with the ordinances and laws regulating sanitation.
Section 2: If any section, subsection, paragraph, clause, phrase
or sentence of this ordinance, or the application of same to a particu-
lar set of circumstances or persons should, for any reason be held
invalid, such invalidity shall in no wise affect the remaining provisions
of this ordinance and to this end, all sections and paragraphs hereof
are declared to be severable.
Section 3: Any person
shall be deemed guilty of a
less than One ($1.00) Dollar
violating any provision of this ordinance
misdemeanor and subject to a fine of not
nor more than Two Hundred ($200.00) Dollars.
Section 4: This ordinance shall take effect from and after ten
(10) days from its passage by the City Council. The City Clerk is here-
by directed to give notice hereof by causing the caption of this ordin-
ance to be published in the official newspaper of the City of Baytown
at least twice prior to the effective date thereof.
INTRODUCED, READ and PASSED by the affirmative vote of a majority
of the City Council, of the City of Baytown on this, the 14th clay of
October, 1955.
