Ordinance No. 756ORDINANCE NO. 756 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTO14N PROVIDING FOR THE APPROVAL OF THE AGREE - MENT, DATED SEPTEMBER 9, 1965, BETWEEN THE STATE OF TEXAS AND THE CITY OF BAYTOWN, FOR THE CONTINUED EXISTENCE, USE, OPERATION AND 1v1AINTENANCE OF HIGH - IVAY TRAFFIC SIGNAL AT THE LOCATION SHOWN ON EXHIBIT ONE (1), ATTACHED HERETO AND MADE A PART HEREOF, IN THE CITY OF BAYT01'-1N; REPEALING ORDINANCES INCONSIST- ENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDIiG FOR THE EXECUTION OF SAID AGREEMENT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the certain agreement, dated September 9, 1965, between the State of Texas and the City of Baytown, for the continued existence, use, operation and maintenance of a certain highway traffic signal at the location shown on EXHIBIT ONE (1), attached hereto and made a part hereof, in the City of Baytown, be and the same is hereby approved, and the i.iayor and City Clerk are hereby authorized and directed to execute said agreement on behalf of the City of Baytown, and to transmit the same to the State of Texas for appropriate action. Section 2: All ordinances or parts of ordinances incon- sistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, subsection, para- graph, sentence, clause or phrase of this ordinance or the appli- cation of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such in- validity shall not affect the remaining provisions of this ordin- ance or their application to sets of stances and, to this end, all provisions declared to be severable. Section 4: The fact that the existing highway traffic signal, named in the above Section 1, is needed, creates an emer- gency which for the immediate preservation of the public peace, health, safety and general welfare requires that this Ordinance take effect immediately from and after its passage, and it is accordingly so ordained.
