Ordinance No. 754I ORDINANCE NO. 754 AN ORDINANCE AUTHORIZING AND ORDERING A SPECIAL ELECTION TO BE HELD ON THE 18th DAY OF SEPTEMBER, 1965, FOR THE PUR- POSE OF PERMITTING THE QUALIFIED VOTERS OF BAYTO'N TO DECIDE VJHETHER OR NOT THE SALARIES OF THE 1.1EMBERS OF THE POLICE AND FIRE DiEPARTi,iENTS, COVERED BY CIVIL SERVICE =, SHOULD BE IN- CREASED BY FIFTY (:x50.00) DOLLARS PER PERSON PER 16ONTH; PRO- VIDING THAT SUCH SALARY INCREASE SHALL BECOIv1E EFFECTIVE NO LATER THAN OCTOBER 1, 1965, SHOULD SUCH RAISE RECEIVE THE FAVORABLE VOTE OF THE ELECTORATE; PROVIDING FOR A FORM; OF BALLOT; PROVIDING FOR ELECTION OFFICIALS, DESIGNATING THE PLACES AND IvWgNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. WHEREAS, Article 1583 -2, Vernon's Annotated Penal Code of the State of Texas, provides for minimum salaries for Policemen and Fire- men in certain cities; and WHF,REAS, such Article states that the Police and Fire Depart- ments may petition the City Council for a salary increase; and WHEREAS, the City Council has waived the necessity of such De- partments presenting to it a petition as prescribed in said Article 1583 -2; and LJHE,REAS, the City Council of the City of Baytown wishes to call an election for September 18th, 1965, for the purpose of permitting the qualified voters to decide whether or not the salaries of each member of the Police and Fire Departments, covered by Civil Service, should be increased by $50.00 per person per month; NO11, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOW14: Section 1: That the City Council of the City of Baytown hereby authorizes and orders a Special Election to be held on the 18tday of September, 1965, for the purpose of permitting the qualified voters of the City of Baytown to decide whether or not the salaries of each member of the Police and Fire Departments, covered by Civil Service, should be increased by :x50.00 per person per month. Section 2: That such salary increase shall become effective no later than October 1, 1965, should such raise receive the favorable vote of the electorate. 4. ORDINANCE NO. AN ORDINANCE AMENDING "AN ORDINANCE DEFINING THE FIRE LIMITS OF THE CITY OF BAYTOWN; REPEALING ORDINANCES IN CONFLICT THEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECT- IVE DATE THEREOF ", BEING ORDINANCE NO. 446, PASSED BY THE CITY COU14CIL OF THE CITY OF BAYTOWN ON THE 26TH DAY OF SEPTEMiBER, 1957, BY CHANGING SECTION THREE (3) THEREOF TO INCLUDE. NEW BOUNDARIES WHICH SHALL BE DESIGNATED AND KNOWN AS THE FIRE LIMIT AREA OR ZONE NO. TWO (2) OF THE CITY OF BAYTOWN; REPEALING ORDINANCES IN CONFLICT THEREWITH; PROVID- ING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECT- IVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Section Three (3) of said Ordinance No. 446 shall be amended by changing Sub - Section (A) to include new bound- aries which shall be designated and known as City of Baytown's Fire Limit or Area No. Two (2), as follows: Section 3: Fire Limit Area or Zone No. 2: The boundaries of Fire Limit Area or Zone No. Two 2 shall be as follows: (A) BEGINNING at the point of intersection of the West right of way line of Main Street, formerly known as Wooster -Goose Creek County Road, with the North right of way line of Market Street; THENCE, North 54 degrees 03 minutes Jest along the said right of way line of 1,'Iarket Street, to a point which is the West right of way line of a street for- merly known as Avenue "A", now designated Market Street, for corner; THENCE, South 52 degrees 34 minutes '.hest along the Gdest right of way line of Iviarket Street, formerly known as Avenue "A ", to the point of intersection of said line with a 'slesterly extension of an alley running Easterly and ' Jesterly through Block 2, East Baytown Sub- division, for corner; THENCE, South 81 degrees 13 minutes East along the said extension of the North line of an alley running Easter- ly and Viesterly through Block 2, East Baytown Subdivision, and continuing in the same direction along the North line of said alley through Blocks 2, 3 and 4, East Baytown Subdivision, to the point of intersection of said line with the West right of way line of Block 5, East Baytown Subdivision, which is also the East right of way line of Huggins Street; THENCE, at right angles in a Southerly direction along the East right of way line of Huggins Street to the South right of way line of the alley in Block 6, East Baytown Subdivision, for corner; THENCE, in an Easterly direction along the South right of way line of said alley to the East right of way line of Louisiana Street; THENCE, in a Southerly direction along the East right of way line of Louisiana Street to the in- tersection of said line with the South right of way line of an alley in Block 28 in Fast Baytown Subdivision, which alley adjoins on the South Lots 1 to 17, inclusive, of said Block 28, facing on Market Street; THENCE, in an Easterly direction along the South right of way line of said alley in Block 2F in East Baytown Subdivision to the intersection of said line with the East line of Lot 23, Block 28, East Baytown Subdivision, for corner; THENCE, in a Southerly direction along the East line of said Lot 23, Block 28, East Baytown Subdivision, a distance of Six (61) Feet, for corner; THENCE, in an Easterly direction One Hundred Fifty (1501) Feet from, and parallel to, the South right of way line of VJest P.tain Street to its intersection with the Vlest right of way line of Lee Drive, for corner; THENCE, in a Northerly direction along the West right or-if wa line of Lee Drive to a point One Hundred Fifty (150' Feet North of the North right of way line of West 14ain Street, for corner; THENCE, in a 1'Jesterly direction One Hundred Fifty (1501) Feet from, and parallel to, the North right of way line of ',Jest 1.1ain Street to its intersection with the East line of Lot or Tract 53 of "Baytown Business Addition ", which line is also designated as the East line of the tract of land conveyed to and now occupied by Britton Cravens Lumber Company and which is also the West line of air tract of land occupied by the Knights of Columbus Hall, for corner; THENCE, North 34 degrees 30 minutes East 153.16 feet to a point; THENCE, South 19 degrees 56 minutes Last 84.46 feet to a point; THENCE, North 60 degrees 49 minutes East parallel with the South right of way line of 1.1arket Street Road to a distance of 261.95 feet, for corner; THENCE, at right angles in a Southerly direction to the intersection of a line which is located 150 feet South of, and parallel to, the South right of way line of P.°iarket Street, for corner; THENCE, in an Easterly direction along said line which is located 150 feet from and parallel to the South right of way line of Miarket Street Road to the point of intersection of said line with a line bearing North 12 degrees 05 minutes Viest described in right of way deed from Pars. Georgia Pruett, et al to City of Goose Creek, dated December 11, 1944; THENCE, in a Northwesterly direction along said last described line and its extension thereof to the point of intersection of said line, as extended, with the North right of way line of Market Street; -2- M THENCE, along the North right of way line of Ifarket Street Road with its curvature in an Easterly direc- tion to the point of intersection of said line with the North right of way line of Viest Texas Avenue Extension. THENCE, in a Northerly direction along the 'Jest right of way line of Decker Drive with its curvature to the point of intersection of said line with the Viesterly extension of a line which is located 100 feet South of, and parallel to, the South right of way line of `Jest Sterling. THENCE, in an Easterly direction along said 'Jesterly Extension of a line which is located 100 feet South, and parallel to, the South right of way line of 'Jest Sterling to a point of intersection of said line with a line which is located 100 feet East, and parallel to, the East right of way line of Decker Drive; THENCE, in a Northwesterly direction parallel with Decker Drive and at all points a distance of 100 feet from the East right of way line thereof, a distance of 1200 feet; THENCE, at right angles in a llesterly direction at 100 feet crossing the Easterly right of way line of Decker Drive, to a point which is located 150 feet 'Jest of the Westerly right of way line of said Decker Drive; THENCE, at right angles in a Southeasterly direction parallel with Decker Drive and at all points 150 feet l'Jest of the Westerly right of way line thereof, to the point of intersection with the North right of way line of I'lest Texas Avenue Extension; THENCE., in a generally Southwesterly direction parallel with the North right of way line, and following the meanderings thereof, of I:iarket Street, and at all points 150 feet North of the said right of way line thereof to a point which is 100 feet East of the East right of way line of Airhart Drive, formerly known as I.laple Street, which point is also located 150 feet Worth of the North right of way line of 1,Jarket Street; THENCE, in a Northerly direction parallel with the East right of way line of Airhart Drive to the South right of way line of Cedar Street; THENCE, at right angles in a Westerly direction, to a point in the South right of way line of Cedar Street which is also the Northwest corner of Lot 16, Block 13 of Airhart Addition; THENCE, at right angles in a Southerly direction, parallel with the blest right of way line of Airhart Drive, and at all points a distance of 100 feet therefrom, to a point which is 125 feet North of the North right of way line of Iiarket Street; THENCE, in a Westerly direction parallel with the North right of way line of Iyiarket Street and at all points a distance of 125 feet therefrom, to a point in the West right of way line of the alley in Block 5, Airhart Addition; THENCE-', in a Northerly direction along the hest right of way line of said alley to the South right of way line of Cedar Street, for corner; -3- THENCE, in a Westerly direction along the South right of way line of Cedar Street and the Westerly Extension thereof, to a point of intersection of said line, as extended, with the blest right of way line of Main Street, formerly known as the Wooster - Goose Creek County Road, for corner; THENCE, in a Southerly direction along the t4est right of way line of Main Street to the PLACE OF BEGINNING. Section 2: Repealing Clause: All ordinances of parts of ordinances inconsistent with the terms of this ordinance are here- by repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, exception, section, sub - section, paragraph, sentence, clause or phrase of this ordinance, or the application of same to any person or set of cir- cumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the re- maining provisions of this ordinance or their application to other persons or sets of circumstances, and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect from and after its passage by a majority of the City Council of the City of Baytown.
