BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTO':JN: ARTICLE 1: WORDS AND PHRASES DEFINED Section 1: (a) Definition of Words and Phrases: The following words and phrases when used in this ordinance shall, for the purpose of this ordinance, have the mean- ing respectively ascribed to them; and Whenever any words and phrases used in this ordinance are not defined herein, but are defined in the State Laws regulat- ing the operation of vehicles, any such definition therein shall be deemed to apply to such words and phrases used herein. SUBDIVISION 1: VEHICLES, TRAFFIC, ETC. DEFINED Section 2: (a) Vehicle: Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks. (b) blotor Vehicle: Every vehicle which is self- propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. (c) Authorized Emergency Vehicle: Vehicles of the Fire Department, Police vehicles and such ambulances and emer- gency vehicles of municipal departments or public service corpora- tions, as are designated by the City Council of the City of Bay- town. Section 3: (a) Bicycle: Every device propelled by human power upon which any person may ride, having two tandem wheels, either of which is over twenty (2011) inches in diameter, and in- cluding any device generally recognized as a bicycle though equipped with two front or two rear wheels. (b) Motorcycle: Every motor vehicle having a saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor. Section 4: (a) Railroad: A carrier of persons or property upon cars, other than streetcars, operated upon stationary rails. or other motor, on rails, except (b) Railroad with or without streetcars. Train: i,. steam engine, electric cars coupled thereto, operated up - Section 5: Traffic: Pedestrians, ridden or herded animals; vehicles and other conveyances; -either singularly or together, while using any stree c for purposes. of travel. Section 6: Rich- of -Way: The privilege of the imimediate use of the roadway. Section 7: (a) Stoo: Jhen required, means cessation of movement. (b) Stogy, Stoppinq or Standing: ',!henprohibi ted, means any stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of .a police -officer or traffic control sign or signal. (c) Park: .then prohibited, :jeans the standing �7 a vehicle, whether occupied or no., otherwise, than temporarily fcr the purpose of and while actually engaged in loading or unloading. Section 8: Official Time Standard: Jhenever certain houic are named herein they shall_ mean standard time or daylight-saving, time as may be in current use in this City. SUBDIVISION IT - PERSONS ET, DEFINED Section g: (a) Persons: Lvery natural person, firm, co- partnership, association or corporation. (b) Driver: Every person who drives or is in actual physical cont -col of a vehicle. (c) Pedestrian: Any person -afoot. Section 10: (a) Police Officer: Lavery officer cf the munici- pal department or any otheF7 officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. SUBDIVISION I I I ETC. DEFINED Section 11: (a) Street or Highway: The entire width between the boundary lines of every way publicly maintained when any par(-,- thereof arethereof is open to the use of the public for }purposes of vehicular travel. (:D) Private Road or Driveway: Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner. (c) Roadway: That portion of a street.or highiway improved, designed or ordinarily used for vehicular travel. In the event a highway includes two or more separate roadways the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways collectively. -2- (d) Sidewalk: That portion of a street between the curb lines of a roadway and the adjacent property lines intendeu: for the use of pedestrians. Section 12: Intersection: (a) The area embraced within the prolongation or connection of the lateral curb lines or, if none, then the lateral boundary lines of the roadways of two highways which join one another at or approximately at right angles, or the area within which vehicl!:s traveling upon different highways joining at any other angle may co�c: in conflict. (b) Uhere a highway includes two roadways thirty (30') feet or more apart, then every crossing of each roadway of suer. divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways thirty (301) feet or more apart, then, every crossing of two roadways of such highways shall be regarded as a separate intersection. Section 13: Crosswalk: (a) That part of a roadway at an intersection in- cluded within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs, from the edges of the traversable roadway. (b) ilny portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines o._ other markings on the surface. Section 14: Safety Zone: (a) The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protcc!.,,,U or is so marked or indicated by adequate signs as to be plainly v�.:,, ible at all times while set apart as a safety zone. (b) Passer er Loading Zone: A space adjacent to a curb reserved for the exclusive use of vehicles doing the loading or unloading of passengers. (c) Loading Zone: Aspace adjacent to a curb re- served for the exclusive use of vehicles doing the loading or unload- ing of passengers or materials. Section 15: (a) Official -Traffic -Control Devices: "111 signs, signals, markings and devices not inconsistent aith this ordinance placed.or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic. (b) Traffic -Control Signal: Any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and to proceed. (c) Traffic --Control Sign or Device: All signs; signals, markings and devices not inconsistent with this ordinance placed or erected by authority of the City Council of the City of E'�_y town for the purpose of regulating, warning or guiding traffic. ARTICLE II - AUTHORITY OF POLICE Section 16: Police to Direct Traffic: It shall be the duty the Police Department of this City to enforce the provisions of this ordinance. Officers of the Police Department are hereby authorized to direct all traffic, either in person or by means of visible audible signals in conformance with the provisions of this ordinanc.. providing that in the event of a fire or other emergency or to exped- ite traffic or safeguard pedestrians, officers of the Police or Fir,c -3- Department may direct traffic, as conditions may require, notwith- standing the provisions of this ordinance. Section 17: !he City Council _.-.uthorized to Adopt Emergence and oth_e_r Regulations Ths City Council is hereby empowered, by resolution, to ; ake and enforce regulations necessary to rake effect- ive the provisions of this ordinance and to make and enforce te�por- ary regulations to cover emergency or special conditions. Section 18: Obedience to PoliceOf_f_icers: A person shall wil- fully fail or refuse to comply ..with any lawful order or direction of any police cffi cer investeo by law with authority to direct, control or regulate traffic, Section 19: Pablic Officers and Emgloeees to Obey Ordinance Exception: The provisions of this ordinance applicable to the drivers of vehicles upon tno highways shall apply to the drivers of all vehicles owned or o aerated. by the United States, this state or any county, city, Koon, district, or any other political subdi- vision of the state, subject to such specific exceptions as are set forth in this ordinance with reference to authorized emergency vehicles. Section 23: It shall be illegal for any person to 'Jay-iJal'c ' upon any street in a business area. "Business .Area" shall mean and include business districts as defined in the State Uniforri Traffic Code. t1RTICLE IV: DRI .LNG REGULfATION5 RULES OF THE ROAD Section 24: Drive on Right Side of Roadway_ : Exception: Upon all roadways the driver of a vehicle shall drive upon the richt half of the roadway, except as follows: 1. ihen overta'Ann and massing another vehicle proceeding .in the sante direction under the rules governing such movec�ont. 2. ihen the right half of a roadr:,ay is closed to traffic while under construction or re0air. 3. Upon a roadway divided into three (3) marked lanes for traffic under the rules applicable thereon. 4. Upon a road).vay designated and signposted for one-way traffic. Section 25: Passing Vehicles Proceeding in Opposite Direction: Drivers of vehicles proceeding in oppasito directions shall pass each other to the right and upon the roadways having width for not mare than one line of traffic, in each direction, each driver shall give the other at least one-half (1/2) of the main traveled portion. Section 25: Overtaking a Vehicle on the Left: The folloviing rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to those limitations, exceptions and special rules hereinafter stated: 5- (a) The driver of a vehicle overtaking another vehicle pro- ceeding in the sage direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle. (b) Lxcept when overtaking and passing on the right is per- mitted, the driver of an overtaken vehicle shall give away to the right in favor of the overtaking vehicle on audible signal and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. Section 27: 'dhen Overtaking on the Right is Permitted; (a) The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions: 1. ',then the vehicle overtaken is making or about to make a left turn. 2. Upon a one-way street, or upon any roadway on which traffic is restricted to one direction of r.�ovement, if the roadway is free from obstruction and of suf- ficient width for two or more lines of moving vehicles. (b) The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such move- ment in safety. In no event shall such movement be made by driving off the pavement or main traveled portion of the roadway. Section 28: Limitations on Overtaking on the _Left: No vehicle shall be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direc- tion unless such left side is clearly visible, and is free of oncori- ing traffic for sufficient distance ahead to permit such overtaking and passing to be completely made without interferring with any vehicle overtaken. In every event the overtaking vehicle must return to the right hand side of the roadway before coming within one hundred feet of any vehicle approaching from the opposite direction. Section 29: Further Limitations on Driving to Left of Roadwa (a) No vehicle shall, at any tire, be driven to the left side of the roadway under the folloviing conditions: 1. '.there sight restriction is such that the section of highway being traversed lies within a no -;gassing zone, as determined and marked in accordance with Section 30 herein. 2. llhen approaching within one hundred feet of any bridge, viaduct or tunnel. 3. ilithin one hundred feet of an intersection. (b) The foregoing limitations shall not apply to one-way road- ways. Section 30: No PassinyZone: The City Council of the vitt' of Baytown is hereby authorized to determine, by resolution, those por- tions of any highways in the City limits of the City of Baytown where overtaking and passing or driving on the left side of the roadway would be especially hazardous and may, by appropriate signs or mark- ings on the roadway, indicate the beginning and end of such zones and, when such signs or markings are in place and clearly visible to any ordinarily observant person, every driver of a vehicle shall obey the directions thereof. -6- Sectir)n 31: One --'.Jay Roadways and RotaryTraffic Islands: (a) The City :,cunci 1 of the amity of Bayto,.•m --.ay designate any highvJay or any separate roadc°,ay, under its jurisdiction, for traffic and shall erect appropriate signs giving notice thereof. (c) The driver of a vehicle ;gassing around a rotary traffic island shall drive only to the right of such island. Section 32: Driving on Roadways i.aned for Traffic: .fhenever an;, roadway has been divided into ti -,,,o or rr.ore clearly Harked lanes for traffic, the following rules, in addition to all others consistent herewith, shall apply: (a) The driver of a vehicle shall drive as nearly as practical entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety. (b) Upon a roadway which is divided into three lanes, the driver of a vehicle shall not drive in the center lane except when overta,cing and passing another vehicle a,ihere the road is clearly visible and such center lane is clear of traffic t,Jithin a safe distance, or in prepara- tion for a left turn or where center lane is at the time exclusively allocated to traffic moving in the direction the vehicle is proceeding and is signposted to give notice of such allocation. (c) Official signs may be erected directing slot%, T.-,oving traffic to use a designated lane or designating those lanes to be used for traffic moving in a particular direction regardless of the center of the roadway and drivers of vehicles shall obey the direction of every such sign. -7- Section 33: Following Too Closely_: The driver of a motor vehicle shall not follow another vehicle more closely than is reason- able and prudent, having due regard for the speed of such vehicles and the traffic upon and conditions of the highway. Section 34: Dr_ivinq on Divided Highways: Jhenever any high- way has been divided into two roadways by leaving an intervening space or by a physical barrier or a clearly indicated driving sec- tion so constructed as to impede vehicular traffic, every vehicle shall be driven only upon the right-hand side of the roadway and no vehicle shall be driven over, across or within any such dividing space, barrier or section, except through an opening in such physi- cal barrier or dividing section or space at a crossover or inter- section established by public authority. ARTICLE V. TURNING itND STARTING AND SIGNid-S ON STOPPING AND TURNING Section 35: Ftieg_u_ired Position and Method of Turning at Inter- sections: The driver of a vehicle intending to turn at an inter- section shall do so as follows: (a) Both the approach for right turn and a right turn shall be made as close as practical to the right-hand curb or edge of the roadway. (b) Approach for a left turn from a two-way street into a two-vray street shall be made in that portion of the right half of the roadway nearest the centerline thereof and after entering the intersection the left turn shall be made so as to leave the inter- section to the right of the center line of the roadway being entered. (c) Approach for a left turn from a two-way street into a one- way street shall be made in that portion of the right half of the roadway nearest the center line where it enters the intersection. A left turn from a one --way street shall be made by entering the in- tersection as close as practical to the left curb or edge of the roadway by which the intersection is entered and by passing to the right of the center line of the street being entered upon leaving the intersection. (d) .!here both streets or roadways are one-way, both the ap- proach for a left turn and a left turn shall be made as close as practical to the left-hand curb or edge of the roadway. (e) The Cit,, Engineer, in cooperation with the Police Depart- ment, may cause markers,buttons or signs to be placed within or ad- jacent to intersections and thereby require and direct that a differ- ent course from that specified in this ordinance be traveled by vehicles turning at an intersection, and when markers, buttons or signs are so placed no driver of a vehicle shall turn a vehicle at an intersection other than as directed and required by such markers, buttons or signs. Section 36: Starting Parked Vehicles: No person shall start a vehicle which is stopped, standing or parked, unless and until such movement can be made with safety. Section 37: TurningMovements and Required Signals: (a) No person shall turn a vehicle at an intersection unless the vehicle is in proper position upon the roadway, as required in Section 35, or turn a vehicle to enter a private road or driveway or otherwise turn a vehicle from a direct course or move right or left upon a roadway unless and until such movement can be made with safety. No person shall so turn any vehicle without giving an appro- priate signal in the manner hereinafter provided and in the event no other traffic may be affected by such movement. (b) A signal of intention to turn right or left, when required, shall be given continuously during not less than the last one hundred feet traveled by the vehicle before turning. n a vehicle without first giving an appropriate signal in the manner provided herein to the driver of any vehicle immediately to the rear when there is opportunity to give such signal. Section 33: Siqnals by Hand and;`16rrrj or Signal Device: Any stop or turn signal, when required herein, shall be given either by means of the hand and arm or by a signal lamp or lamps or mechanical signal device of a type approved by the Texas Department of Public Safety, but when a vehicle is so constructed or loaded that a hand and arm signal would not be visible both to the front and rear of such vehicle, then, said signals must be given by such lamp or lamps or signal device. Section 39: t1ethod of Givinq Hand and firm Signals: All signals herein required given by hand and arm shall be given from the left side of the vehicle, in the follovjinn runner and such sig- nals shall indicate as follows: 1. Left Turn: Hand and arm extended horizontally. 2. Right Turn: Hand and arm extended upward. 3. Stop or Decreased Speed: Hand and arm extended downward. Section 40: Limitations op. Turning_ Around: (a) It shall be unlavjf ul for the operator of any vehicle to turn such vehicle so as to proceed in the opposite direction unless such movement can be made in safety and without backing or otherwise interfering with other traffic. (b) A complete turn shall not be made at any intersection of any two streets or upon any street or alley in the City of Bayto�,rn where the City Council may determine that it is unsafe to make a complete turn and shall have posted at such place, in the street or alley, a sign showing that a complete turn is prohibited. Section 41: Emerging FromAlle or Private Driveway, The operator of a vehicle emerging from an alley, driveway or building, shall stop such vehicle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across any alleyway. Section 42: Vehicles Shall moot Be Driven on the Sidewalk: The operator of a vehicle shall not drive or part: said vehicle with- in any sidevjalk area except at a permanent or temporary driveway. ;,RTI'CL VI. ``.u:�li)� NT:�, i :LL S DRIVI dG, STI�RTIIJG PARKED VEHICLES Section 43: Immediate Report of Accident: (a) The driver of a vehicle involved in an accident resulting in injury to or death of any person, or property damage to an appar- ent extent of X25.00 or more, shall immediately by the quickest means of communication, either verbal or written, give notice of such accident to the Police Department if such accident occurs within the i"i ty of Baytown. (b) It shall be unlawful for the driver or any other person to remove such vehicle from the scene of the accident until author- ized to do so by a police officer of the Police Department of this City; provided, however, that the foregoing small not apply if there exists or arises a duty on the part of such driver or other persons in control of such vehicle to use said vehicle in carrying any per- son injured in said accident to a physician or surgeon for medical or surgical treatment. (c) The Police Department of this City, acting by an officer of the traffic division or the Chief of Police, may require any driv- er of a vehicle involved in an accident of which report must be made, -9- as provided in this Section, to make supplemental oral or written report whenever the original report is found to be insufficient, or inadequate in the opinion of such officer, and may require witnesses of accidents to render reports to said department. (d) -very law enforcement officer, who in the regular course of duty investigates a motor vehicle accident of which report rust be made, as required in this Section, either at the time of and at the scene of the accident or thereafter by interviewing participants or witnesses shall, within twenty-four hours after completing such in- vestigation, forward a written report of such accident to the Traffic Division of the Police Department of this -ity. every such accident report shall be made on the appropriate form provided by the Traffic Division and shall contain all of the information required therein unless not available. Such reports shall be without prejudice to the officer so reporting and shall be for the confidential use of the Police Department and the Sity Traffic engineer. Section 44: L.Vhen Driver_ Unable to Report: .Jhenever the driver of a vehicle is physically incapable of making a required accident report and another occupant in the vehicle, at the time of the acci- dent, is capable of making a report, such occupant shall make or cause to be made said report. Section 45: Driver of_Wrecker Trucks Not to Interfere :lith Police Investigation of Accidents: It shall be unlaviful for the driver or any person in charge of any vehicle equipped with a crane, hoist, winch or towing device, who has answered a call to or is at- tending the scene of any collision or accident of one or none veh vls on any highway in this City, to remove or atter:pt to remove any vehicle involved in such collision or accident, or in any way inter- fere with or change the position of any such vehicle, except upon authority or direction and in the presence of a police officer of this City, unless such change is made or atte:rpted for the purpose of releasing a person or persons imprisoned within or under such vehicle involved in such collision or accident, provided further, that it shall be unlawful for the driver, or person in charge of any vehicle equipped with a crane, hoist, winch or towing device to remove any vehicle from the scene of accident or collision �-Athcut the consent cf the owner of the vehicle, unless directed by a police officer to re- move such vehicle as a public safety measure or for the protection of private property. Section 46: Accident InvolvingDamageto Vehicle: The driver of any vehicle involved in an accident resulting in damage to a ve- hicle which is driven by any person shall irimediately stop such vehicle at the scene of such accident or as close thereto as possible but shall forthwith return to and in every event ren --gain at the scene of such accident until he has given his name, address and the regis- tration number of the vehicle he is driving and shall, upon request and if available, exhibit his operator s, cor.-:mercial operator's or chauffeur's license to the driver or occupant of any vehicle collided with. Section 47: Duty Upon Strikinq Unattended Vehicle; The driver of any vehicle k^Ihich collides with and damages any vehicle which is unattended, shall immediately stop and shall then and there either .locate and notify the operator or owner of such vehicle, of the nar3e and address of the driver and owner of the vehicle striking the un- attended vehicle or shall leave, in a conspicuous place in or secure- ly attached to and plainly visible, a written notice giving the name and address of the driver and of the owner of the vehicle doing the striking and any statement of the circumstances and shall rake a re- port of such accident when and as required in Section 43 hereof. Section 48: Dut U on Strikipq Fixtures Upon a ! w�: The driver of any vehicle involved in an accident resulting only in dam- age to fixtures legally upon or adjacent to a highway, shall take -10- reasonable.steps to locate and notify the owner or person in charge of such property of such fact and of his name and address and of the registration number of the vehicle he is driving and shall, upon request and if available, exhibit his operator's, commercial opera- tor's or chauffeur's license, and shall make report of such accident when and as required in Section 43 hereof. section -49: Garages to Keep Records ,& Report Damaged Vehicles: The person in charge of any garage or repair shop shall keep a recd" of all damaged vehicles which show evidence of having been involved in an accident or wreck or struck by bullets. This record shall be available for police inspection and shall show the name of the drive--,- or riveror person in charge of the vehicle, the license number, model and type of same, a description of the damage of vehicle and the date brought in for repair. Section 50: Reckless Driving: Every person who drives any vehicle in wilfuli or wanton disregard of the rights or safety of others or without due caution or circumspection, and at a speed or in a manner so as to endanger or be likely to endanger a person or property, shall be guilty of reckless _'.riving. ARTICLE VII - TRAFFIC AND PEDESTRIAN SIGNALS Section 51: Traffic Control Signal Legend: Whenever traffic is controlled by traffic control signals exhibiting the words "GO", "CAUTION" or "STOP" or exhibiting different colored lights success- ively one at a time, or with arrows, the following colors only shat' be used and said terms and lights shall indicate and apply to drive-,- of vehicles and pedestrians as follows: (a) Green, alone or "GO." 1. Vehicular traffic facing the signal, except when prohibited under the provisions of this ordinance, may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right of way to other vehicles and to pedestrians lawfully with- in the intersection or an adjacent crosswalk at the time such signal is exhibited. 2. Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk. (b) Yellow, alone or "CAUTION' when shown following the green or "GO" signal. 1. Vehicular traffic facing the signal is thereby warned that the red or "STOP' signal will be exhibited im- mediately thereafter and such vehicular traffic shall not enter or be crossing the intersection when the red or "STOP" signal is exhibited. 2. Pedestrians facing such signal are thereby advised there is insufficient time to cross the roadway, and any pedestrian then starting to cross shall yield the right of way to all vehicles. (c) Red, alone or "STOP." 1. Vehicular traffic facing the signal shall stop be- fore entering the crosswalk on the near side of the intersection or, if none, before entering the inter- section and shall remain standing until green or "GO" is shown alone. 2. No pedestrian facing such signal shall enter the roadway unless he can do so safely and without inter -- f erring with any vehicular traffic. see c(e) In the event ar. cffici<.y on,;r l vin r Mavis is erected and r}aintained at a place other than intersections, the provisions of this section shall he applicable except as to those provisions which, by their nature, can have no application. Any stop required shall be made at a sign or r.,�arking on the pavement indicating where the stop shall be rade, but in the absence of any such sign or marling the stop shall be .jade at the signal. Section 52: Pedestrian Walk & Wait Signals: `.dhenever special pedestrian signals exhibiting the word �`JALKI' or '':11'�IT` are in place, such signals shall indicate as follows: (a) ,talk: Pedestrians facing such signal may proceed across the roadway in the direction of the signal and shall be given the right of way by the drivers of all vehicles. (.)) ',.'Jait: No pedestrian shall start to cross the roadway in the direction of such signal, but any pedestrian who has partially completed his crossing on the wall: signal shall proceed to a side- walk or safety island �,.hile the wait signal is showing. Section 53: Flash_inqS.ignals: '.henever flashing red or yel- low signals are used they shall require obedience by vehicular traffic as follows: 1. Flashing iced (Stop Signal): .ihen a red lens is illuminated by rapid intermittent flashes, driv- ers of vehicles shall stop before entering the nearest crossway- at an intersection or at a li •,it line when r::ar}ced and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign. 2. FlashingYellow (Caution Signal)::' en a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the inter- section or past such signal only with caution. Section 54: Display of Unauthorized Signals or Markin s: (a) i,3o person shall place, maintain or display upon or in view of any highway any unauthorized sign, signal or marking or de- vice or railroad sign or signal �=hick attempts to direct the move- ment of traffic, or which hides Burr vier of iiiterfer.,s with the effectiveness of any official traffic control device or any rail- road sign or signal, and no person shall place or maintain nor shall any public authority permit upon any highiay any traffic sign or signal bearing thereon any commercial advertising. This shall not be deemed to Prohibit the erection upon private property adjacent to highways or signs having useful directional inforc;ation and of a type that cannot be mistal�en for official signs., (b) Every such prohibited sign, signal or marking is hereby declared to be a public nuisance and the Chief of Police is hereby empowered to remove the same or cause it to be removed without notice. Section 55: Interference with Ufficial. Traffic Control De- vices or Railroad Signs or Signals: leo person shall, f,aithout law- ful authority, attempt to or in fact alter, deface, injure, knock: down or remove any official traffic control device or any railroad sign or signal or any inscription, shield or insignia thereon, or any part thereof. 1;RTICLE VIII - PEDESTRIl NS ' RIGHTS AND DUTIES Section 56: Pedestrians Subject_to Traffic Regulations: (a) Pedestrians shall be subject to traffic control signals at intersections, as provided in this ordinance, but at all other ;daces pedestrians shall be accorded the privileges and shall 'be subject to the restrictions stated in this article. (,b) Pedestrians shall strictly comply with the directions of all official traffic control signals in the amity of Bayto,^.,n and it shall be unlawful for any pedestrian to cross any street or road- way in the fire limits of the --ity of Baytoirn except in a designated crosswalk. Section 57: Pedestrians'_Right of Way in Crosswalks: (a) .!hen traffic control signals are not in place or not in operation, the driver of a vehicle shall yield the right of way, sloiuing down or stopping if need be to so yield, to a pedestrian crossing the roa&!ay ,`, ithin a cross,%jallc +:when the pedestrian is upon the half of the roaet•:ay t•ahich the vehicle is traveling, or k%then the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, but no pedestrian shall suddenly leave a curb or other place of safety and �,.al'c or run into the path of a vehicle which is so close that it is iripossible for the driver to yield. Section 59: Drivers to exercise Due Care: :•lot:^liths tan di ng the foregoing provisions of this article, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway and shall give warning by sounding the horn when neces- sary and shall exercise proper precaution upon observing any chile: or any confused or incapacitated person upon a roadway. Section 60: Pedestrians on Roadways: (a) `.!here sidewal;.s are provided it shall be unlawful for any pedestrian to wal'c alone and upon an adjacent roa&tay. ARTICLE: IX - PARKING RLGULATICNS Section 61: Parallel Parking: it shall be unlawful to pari: any character cf vehicle upon any street, except as ,provided in this ordinance, in any other manner than that, the said vehicle shall be parallel with the street upon t°!hi.ch it is pared and upon the right side thereof, determined by the ,,jay said vehicle is headed, and parked so that the wheels on the right side of said vehicle shall be within eighteen (1!R") inches of the curb or edge of the roadway. Section 62: Angle Parking.: It shall be lawful to park vehi- cles at an angle not neater than 4�5 degrees to the line of traffic at such places in the City of Baytown as the City Council shall, by resolution, determine that angle par!cing shall be permitted and shall cause the same to be marked or signed; and in all places where sidewalks have been set back and provisions made for parking vehicles across or inside of the usual curb line on any street in the City of Baytot,jn. (b) .any driver of a vehicle, operator of a rotor driven vehicle, or pedestrian, .rho apnroaches or cares in contact vJith a person wholly or partially blind and carryii, j a cane or stick white in color, or white vli_th red end, shall ir.z:;ediately come to a full stop and take such other precautions, before pro- ceeding, as may be necessary to avoid accident or injury to the person carrying such cane or walking stick. (c) Any person, other than a person wholly or partially blind, who shall carry a cane or walking stick white in color or white with red end, or whc shall fail to corse to a full stop when approach- ing or coring in contact with a person vrholly or partially blind and carrying a walking stick .vhite in color or white with red end, or who shall fail to take such precautions before proceeding as may be necessary to avoid accident or injury to a person carrying a cane or walking stick, white in color or white v)ith red end, shall be guilty of a misdemeanor. Section 54: Drivin Through Gasoline Station: it shall be unlawful for any person, operating an automobile or other gasoline propelled vehicle,to drive same into or through any garage or gasol- ine station, in the City of BaytOWn, without cor-Ang to a full stop while in such garage or gasoline station. Section 85: Dis la ince f dvertising: It shall be unlawful for anyone to operate any vehicle on any street within the corporate limits of the City of Baytown for the primary purpose of display- ing advertising. Section 36: 0 enin of Vehicle _Doors: It shall be unlawful for the owner, operator or any other person to open the door of a vehicle or to step from a parked vehicle into a roadway or side- walk in such a manner as to interfere vrith or impede the progress of any vehicle or pedestrian. Section 87: Repealing Clause: all ordinances or parts of ordinances inconsistent with the terms of this ordinance are here- by repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3-J: Savings Clause: If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance, or the application of saEie to any person or set of cir- cumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not effect the remaining provi- sions of this ordinance or their application to other persons or sets of circumstances and, to this end, all provisions of this ordinance are declared to be severable. Section 89: Penalty: -any person, firm or corporation violat- ing any provision of this ordinance or failing to observe any pro- vision hereof shall be deemed guilty of a misdemeanor and,upon con- viction, shall be fined in any sum not less than Ten (x10.00) Dol- lars and not more than Two Hundred 0200.00) Dollars. Section 90: Lffective Date: This ordinance shall take effect from and after ten10 days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official news- paper of the City of Baytown, at least twice within ten days after the passage of this ordinance.
