THE CITY OF BAYTOWN' S CIVIL DEFENSE. ORDINANCE NU-,1-
BER 228; REPEALING ORDINANCES INCONSISTENT HERE -JITH;
CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOv N:
Section 1: In the event of national emergency or local emergency,
as provided in the City of Baytown's Civil Defense Ordinance No. 228,
Public Shelter lianagers, duly applinted by the Civil Defense Director,
shall open public shelters, take charge of all stock of food, water
and other supplies stored in said shelters, admit the public according
to the City's shelter use plan and take whatever control measures are
necessary for the protection and safety of the occupants.
Section 2: Shelter Managers are authorized to use reasonable re-
straint against those who refuse to cooperate with the routine of shel-
ter living under emergency conditions and it shall be unlawful for any
person to wilfully obstruct, hinder or delay Shelter Managers in comply-
ing with or attempting to comply with control measures necessary under
emergency conditions.
Section 3: Repealing Clause: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby repealed; pro-
vided, however, that such repeal shall be only to the extent of such
inconsistency and, in all other respects, this ordinance shall be cumula-
tive of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 4: Savings Clause: If any provision, exception, section,
subsection, paragraph, sentence, clause or phrase of this ordinance or
awl the application of same to any person or set of circumstances shall, for
any reason, be held unconstitutional, void or invalid, such invalidity
shall not effect the validity of the remaining provisions of this ordin-
ance or their application to other persons or sets of circumstances and,
to this end, all provisions of this ordinance are declared severable.
Section 5: Effective Date: This ordinance shall take effect from
and after its passage by a majority of the City Council.
INTRODUCED, READ and PASSED by the affirmative vote of the City
Council of the City of Baytown, on this the 24 day of Jug 1 1955.
