ORDINANCE NO. `34
AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE,
AND CLOSING A PORTION OF RIGHT OF WAY OVER AND ACROSS
A TRACT OF LAND SITUATED IN THE WILLIAM SCOTT LOWER
LEAGUE, ABSTRACT NO. 65, IN THE CITY OF BAYTOWN, HARRIS
COUNTY, TEXAS, AND ABANDONING AND QUITCLAIMING ALL
INTEREST OF THE CITY OF BAYTOWN AND THE PUBLIC IN AND
TO SAID PORTION OF RIGHT OF WAY, AND AUTHORIZING THE
MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AND
DELIVER A CONVEYANCE TO THT' ABUTTING OWNERS.
WHEREAS, the following described portion of the Right of Way
heretofore granted by WILLIAM WRIGHT to HARRIS COUNTY, TEXAS, by instru-
ment dated June 5, 1922, recorded in Volume 508, Page 218, of the Deed
Records of Harris County, Texas, lying within the corporate limits of
the City of Baytown, Harris County, Texas, is not now used by the Public:
That certain Right of Way over and across the following described
tract of land situated in the William Scott Lower League, Abstract
No. 65, in the City of Baytown, Harris County, Texas, and described
as follows, to -wit;
BEGINNING at a point situated South 710 East 6135.0 feet and North
200 53' East 524.5 feet from the Northwest corner of the Thomas
Wright, Jr. tract and the Southwest corner of the William Wright
tract, the said corner being on the East line of the George Wright
tract;

Bayou, being also kn

to a stake;
THENCE South 800 03'
THENCE South 200 53'
East 617.7 feet to the West Bank of Cedar
own as the Kilgore's landing;
East along the Bank of Cedar Bayou 64.2 feet
West 617.7 feet to a stake;
West 64.2 feet to the POINT OF BEGINNING;
AND being part of the land described in that certain Right of Way
heretofore granted by William Wright to Harris County, Texas, by
instrument dated June 5, 1922, recorded in Volume 508, Page 218,
of the Deed Records of Harris County, Texas; and
WHEREAS, no interest of the Public requires that said portion
of the Right of Way above described be improved or kept open, but the
needs of the Public will be adequately served by the use of the remaining
portion of said Right of Way; and

WHEREAS, the interest of the Public will be benefited by
the termination of the obligation on the part of the City of Baytown
to repair, improve and maintain said portion of Right of Way above
described as public way; and
WHEREAS, the only owners of property abutting or adjoining
the above described portion of Right of Way have made application that
same be discontinued, closed and abandoned; and
WHEREAS, it appears to be to the best interest of the City
of Baytown, Harris County, Texas, that the above described portion of
Right of Way be discontinued, closed and abandoned, and it further
appears that the interest of no other owners of property or of the
Public in general will be prejudiced or impaired thereby; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1, That the above described portion of Right of Way
over and across the above described tract of land situated in the William
Scott Lower League, ,Abstract No. 65, lying within the corporate limits
of the City of Baytown, Harris County, Texas, be and the same is hereby
discontinued and abandoned for Public use, and the City of Baytown does
for itself and the Public abandon and quitclaim all interest in and to
the above described portion of Right of Way, and does hereby approve
the application of said owners of the property abutting said portion
of Right of Way.
Section 2: That the Mayor of the City of Baytown is hereby
authorized and directed to execute and the City Clerk to attest and
deliver an appropriate conveyance of said portion of said Right of Way
to the owners of property abutting same.
INTRODUCED, READ and PASSED by the affirmative vote of a
majority of the City Council of the City of Baytown, Texas, on this
