AN ORDINANCE ESTABLISHING SPEED LIMITS DURING
CONSTRUCTION ON A PORTION OF SPUR 330 WITHIN
THE CITY LIMITS OF BAYTOM, TEXAS; REPEALING
ORDINANCES INCONSISTENT HEREWITH; CONTAINING
A SAVINGS CLAUSE; PRESCRIBING A MAXIh- MI PENALTY
OF TWO HUNDRED (45200.00) DOLLARS AND PROVIDING
FOR THE: P'JBLICATICN AND EFFECTIVE DATE THEREOF.
WHEREAS, the Texas Highway Department has made it known to the
City of Baytown that operations will begin in the near future for the
second stage development of Spur 330 between Bayway Drive and Loop 201;
and
iEREAS, in the interest of safety, it is desirable to maintain
a Construction Speed Zone during the construction period, NOW, THERE-
FORE,
BE IT ORDAINED BY THE CITY CCUNCiL CF THE CITY OF BAYTO JN:
Section 1: That a Construction Speed Zone be established along
Spur 330 ram a point 2000 feet ;Jest of Bayway Drive to jArhart Drive,
a distance of approximately 3.979 miles, 40 miles per hour when so
signed within said zone.
Section 2: Necessary signs for posting the Speed Zone will be
furnished, installed and maintained by direction of the Texas Highway
Department's Engineer in charge of the project.
Section 3: All ordinances or parts of ordinances inconsistent
with the terms of this ordinance are hereby repealed; provided, however,
that such repeal shall be only to the extent of such inconsistency, and
in all other respects this ordinance shall be cumulative of other ordin-
ances regulating and governing the subject matter covered by this ordin-
ance.
Section 4: If any provision, section, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same
to any person or set of circumstances, shall for any reason be held un-
constitutional, void or invalid, such invalidity shall not effect the
validity of the remaining provisions of this ordinance or their applica-
tion to other persons or sets of circumstances and to this end, all pro-
visions of this ordinance are declared to be severable.
Section 5: Any person, firm or corporation violating any provi-
sion of this ordinance or failing to observe any provision hereof, shall
be deemed guilty of a misdemeanor and, upon conviction, shall be fined
in any sum not to exceed Two Hundred (:0200.00) Dollars, and each and
every day or fraction thereof, which this ordinance, or any part thereof,
shall be violated, shall be deemed a separate offense and punishable
as such.
Section 6: This ordinance shall be in effect only during the
period of construction, when the roadways or portions of roadway are so
signed, and completion of the project shall automatically cancel the
Speed Zone. The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice prior to the construc-
tion period.
