AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE, AND
CLOSING A PORTION OF DECKER DRIVE, WEST TEXAS AVENUE AND WEST
DEFEE AVENUE ADJACENT TO LOT 1 IN BLOCK 1 OF PRUETT ESTATE
SUBDIVISION NC. 2, AND ABANDONING AND QUITCLAIMING ALL INTEREST
OF THE CITY OF BAYTOWN AND THE PUBLIC IN AND TO SAID PORTION
OF DECKER DRIVE, WEST TEXAS AVENUE AND WEST DEFEE AVENUE, AND
AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST
AND DELIVER A CONVEYANCE TO THE ABUTTING OWNERS.
WHEREAS, the following described portion of Decker Drive, West Texas
Avenue and West Defee Avenue adjacent to Lot 1, in Block 1, of Pruett Estate
Subdivision No. 2, lying within the corporate limits of the City of Baytown,
in Harris County, Texas, according to the Map or Plat thereof recorded in
Volume 35, Page 55, of the Map Records of Harris County, Texas, is not now
used by the Public:
That said portion of Decker Drive, West Texas Avenue and West Defee
Avenue that lies adjacent to and abuts Lot 1, in Block 1, of Pruett
Estate Subdivision No. 2, an Addition in the City of Baytown, Texas,
as shown on Plat recorded in Volume 35, Page 55, of the Map Records
of Harris County, Texas, described as follows, to -wit:
BEGINNING at a point marking the Northwesterly corner of aforesaid
Block 11 of Pruett Estate Subdivision No. 2, on the Southerly line
of West Defee Avenue, said beginning corner being located North 680
41' West, a distance of 324.00 feet from a point marking the North-
easterly corner of the said Block 1;
THENCE North 680 41' West, along the Southerly line of West Defee
Avenue, extended West, a distance of 70.90 feet to a point for corner;
THENCE in a Southeasterly direction along the arc of a curve to the
left, the cord subtended thereof having a bearing of South 210 05' 47"
East, said curve having a radius of 2546.48 feet, and a central angle
of 10 26' 25 ", a distance of 64.02 feet to a point marking the beginning
of a curve to the left;
THENCE in a Southeasterly direction along the arc of said curve, having
a radius of 617.23 feet and a central angle of 250 40' 30 ", a distance
of 276.77 feet to a point for corner;
THENCE North 210 19' East, a distance of 2.77 feet to a point for corner
on the existing Southwesterly line of the aforesaid Block 1, on the
existing Northeasterly line of West Texas Avenue;
THENCE in a Northwesterly direction along the existing Southwesterly
line of the said Block 1, on the existing Northeasterly line of West
Texas Avenue, and following the arc of a curve to the right, having
a radius of 644.53 feet and a central angle of 230 37' 57" a distance
of 265.84 feet, to a point marking the beginning of a curve to the
right;
THENCE in a Northeasterly direction along the arc of said curve, having
a radius of 25.00 feet and a central angle of 1400 09', a distance of
61.15 feet to the PLACE OF BEGINNING, and containing 3,607 square feet
of land; and
WHEREAS, no interest of the Public requires that said portion of
Decker Drive, West Texas Avenue and West Defee Avenue abutting Lot 1, in
Black 1, of Pruett Estate Subdivision No. 2 be improved or kept open, but
the needs of the Public will be adequately served by the use of the remain-
ing portion of said Streets; and
WHEREAS, the interest of the Public will be benefited by the termina-
tion of any obligation on the part of the City of Baytown to repair, improve
and maintain said portion of Decker Drive, West Texas Avenue and West Defee
Avenue as public way; and
WHEREAS, the only owners of property abutting or adjoining the above
described portion of Decker Drive, West Texas Avenue and West Defee Avenue
have made application that same be discontinued, closed and abandoned; and
WHEREAS, it appears to be to the best interest of the City of Baytown,
Harris County, Texas, that the above described portion of Decker Drive, West
Texas Avenue and West Defee Avenue be discontinued, closed and abandoned, and
it further appears that the interest of no other owners of property in said
Pruett Estate Subdivision No. 2 or of the Public in general will be prejudiced
or impaired thereby; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1; That the above described portion of Decker Drive, West
Texas Avenue and West Defee Avenue adjacent to Lot 1, in Block 1, of Pruett
Estate Subdivision No. 2, lying within the corporate limits of the City of
Baytown, Harris County, Texas, according to the Map or plat thereof recorded
in Volume 35, Page 55, of the Map Records of Harris County, Texas, be and the
same is hereby discontinued and abandoned for Public use, and the City of
Baytown does for itself and for the Public abandon and quitclaim all interest
in and to the above described portion of Decker Drive, West Texas Avenue and
West Defee Avenue, and does hereby approve the application of said owners of
the property abutting said portion of Decker Drive, West Texas Avenue
and West Defee Avenue.
Section 2: That the Mayor of the City of Baytown is hereby
authorized and directed to execute and the City Clerk to attest and
deliver an appropriate conveyance of said portion of Decker Drive, West
Texas Avenue and West Defee Avenue to the owners of property abutting
same.
INTRODUCED, READ and PASSED by the affirmative vote of a majority
of the City Council of the City of Baytown, Texas, on this the
