AN ORDINANCE EXTENDING THE APPLICATION OF THE CITY
OF BAYTO'INtS ORDINANCE NO. 723, ESTABLISHING RULES
AND REGULATIONS GOVERNING PLATS AND THE SUBDIVISION
OF LAND , CON &IONLY REFERRED TO AS THE CITY OF BAYTO' /N t S
SUBDIVISION ORDINANCE, TO ALL OF THE AREA UNDER THE
EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTG +I
TEXAS; PROVIDING THAT A VIOLATION OF THE ORDINANCE IN
SUCH AREA OF EXTRATERRITORIAL JURISDICTION SHALL NOT
BE A MISDEI4EANOR NOR SHALL ANY FINE BE APPLICABLE;
PROVIDING FOR ENFORCE?4ENT OF SUCH ORDINANCE BY IN-
JUNCTION IN THE DISTRICT COURT; CONTAINING A REPEALING
CLAUSE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
fflEREAS, the I:;unicipal Annexation Act (Chapter 160, Acts of the
58th Legislature, Regular Session, 1963; compiled as Article 970a, Ver-
non's Texas Civil Statutes) authorizes any city to extend the applica-
tion of its ordinance establishing rules and regulations governing plats
and subdivision of land to all of the area under its extraterritorial
jurisdiction as defined in such Act; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTO'IN:
Section 1: Ordinance No. 723, passed and approved on the 23rd day
of July, 1964, establishing rules and regulations governing plats and the
subdivision of land, and entitled:

PROCURE THE APPROVAL OF THE CITY PLANNING COWIISSION,
CITY OF BAYTOi41; PRESCRIBING A MAXIMMI PENALTY OF TWO
HUNDRED 0200.00) DOLLARS; REPEALING ORDINANCES INCON-
SISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE AND PRO-
VIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF,
is hereby extended in its application to

Section 2: No violation of any provision of such Ordinance No. 723
outside Me corporate limits of the City, but within the City's area of
extraterritorial jurisdiction, shall constitute a misdemeanor under such
ordinance, nor shall any fine provided for in such ordinance be applicable
to a violation within such area of extraterritorial jurisdiction.
Section 3: In the event any provision of Ordinance No. 723 is vio-
lated within the area of extraterritorial jurisdiction of the City of Bay-
town, Texas, and outside its corporate limits, the City may institute any
appropriate action or proceedings in the District Court to enjoin the vio-
lation of such ordinance.
Section 4: Reoealinq Clause: All ordinances or narts of ordin-
ances inconsistent with the terns of this ordinance are hereby repealed;
Provided, however, that such repeal shall be only to the extent of such
inconsistency, and in all other respects this ordinance shall be cumulative
of other ordinances regulating and governing the subject matter covered by
this ordinance.
Section 5: Savings Clause: If any provision, section, subsection,
paragraph, sentence, clause or phrase of this ordinance or the application
of same to any person or set of circumstances shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the
validity of the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and, to this end, all provisions
of this ordinance are declared to be severable.
Section a: �iffective bate: This ordinance shall take effect im-
mediately upon its adoption by a majority of the City Council of the City
of Baytown.
