Ordinance No. 716ORDINANCE NO. 716 AN ORDINANCE AMENDING AN ORDINANCE, "AN ORDINANCE PROMULGATING GENERAL RULES AND REGULATIONS GOVERNING THE PLATTING AND SUBDIVID- ING OF LAND WITHIN THE CORPORATE LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND WITHIN FIVE (5) MILES THEREOF, WITH REGARD TO RULES AND REQUIREMENTS FOR APPROVAL OF THE INITIAL PLAT, FOR SUBDIVISION NAME AND STREET NAMES, FOR LOT SIZES, FOR STREET IMPROVEMENTS, ALLEYS OR EASEMENTS, WATER AND SEWER UTILITY MAIN SERVICE LINES THEREIN, ALL OF SAID RULES AND REGULATIONS ARE FOR THE PURPOSE OF PROMOTING THE HEALTH, SAFETY, MORAL AND GENERAL WELFARE OF THE COMMUNITY; CONTAIN- ING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PRESCRIBING ri MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND THE EFFECTIVE DATE THEREOF ", BEING ORDINANCE NO. 556, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 10TH DAY OF SEPTEMBER, 1959, BY AMENDING SECTION ONE (1), REQUIRE - MENTS FOR THE WATER DISTRIBUTION SYSTEM; PERMITTING THE USE OF ASBES- TOS- CEMENT WATER PIPE IN SUBDIVISIONS; AND PROVIDING FOR THE PUBLICA- TION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That said Ordinance No. 556, is hereby amended by adding thereto Section 1: Requirements for Water Distributing System - as follows: Asbestos- Cement Water Pipe, of domestic manufacture, may be used to construct Water Distribution Systems in the City of Baytown. Where so used, Asbestos- Cement Water Pipe shall conform to the provisions of American Water Works Association Specification 0900 -53T, and shall have a maximum working pressure of 150 psi (pounds per square inch). Asbestos- Cement Water Pipe will be subject to the following restric- tions in use: (1) Pipe to be installed with a minimum of forty (40 ") inches of cover to ground surface. (2) Asbestos - Cement Pipe shall not be installed spanning the trench excavated for installation of sanitary sewers or storm sewers. (3) Asbestos - Cement Pipe will not be used in street crossings, ex- cept where installed through approved metal casing. (4) Asbestos- Cement Pipe will not be installed through manholes in sanitary sewer systems or through drainage structures. (5) Asbestos - Cement Water Pipe may not be used in an area known to be subject to movement of the ground due to fault action Section 2: That all the terms and provisions of the said Ordinance No. 556, passed by the City Council of the City of Baytown on the 10th day of September, 1959, are hereby continued in full force and effect and any person violating any of the terms of the ordinance shall be subject to the penalties provided therein. Section 3: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby di- rected to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance, INTRODUCED, READ and PASSED by a majority of the City Council of the City of Baytown on this the 23rd day of January, 1964.
