Ordinance No. 715J ORDINANCE NO. 715 AN ORDINANCE REQUIRING A PERMIT AND BOND FOR CERTAIN SHOWS, PERFORMANCES AND EXHIBITIONS WITHIN THE CORPORATE LIMITS OF THE CITY OF BAY - TOWN; R ^PEALING ORDINANCES IN CONFLICT HERE- WITH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A MAXIMUM PTNALTY OF T%0 HUNDRED ($200.00) DOL- LARS; AND PROVIDING FOR THE PUBLICATION AND EF- FECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: It shall hereafter be unlawful for any person, firm, corporation or association to give, conduct, exhibit or maintain any show, circus or similar per- formance, of any character whatsoever, without first obtaining a permit from the City Sanitarian. An application for a permit shall be filed with the City Sanitarian on a form furnished by him and shall contain such information as required. A permit fee of Twenty -Five ($25.00) Dollars shall accompany every application submitted. Such permit shall be for one (1) year or for as long as the show or performance is conducted in the City of Baytown; whichever is of less duration. Section 2: The terms of this ordinance shall not apply to any religious activity, or any purely charitable organization or any civic club; provided that charitable organ- izations or civic clubs must receive approval from the City Sanitarian prior to any show- ing and /or performance in the City of Baytown. • Section 3: If issuance of a permit is authorized, same shall not be issued until the applicant shall file with the City Sanitarian a bond executed by the permittee as principal and by a good and sufficient corporate surety company licensed to do business in the State of Texas. Such bond, to be approved by the City Attorney, shall be in the amount of One Thousand ($1,000.00) Dollars and shall be conditioned that the permittee shall operate his show in strict accordance with the health and safety laws of this City and the State of Texas, and will, upon abandoning such show, leave the premises in the same condition, as nearly as practicable, as such premises existed when his show first commenced. Section 4: This ordinance shall apply to all shows, performances, exhibitions, medicine shows, panoramic or view shows, menageries, carnivals, circuses, wild west shows, rodeo shows, acrobatic performances, wax shows, moving picture shows, dramatic or theat- rical productions or skating rinks hereafter held in or exhibited upon the streets of V. IF Baytown, or under any tent within the city limits of the City of Baytown, unless other - guise expressly exempted. Section S: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby expressly repealed, provided; however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the sub- ject matter covered by this ordinance, Section 6: Savings Clause: if any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void or in- valid, such invalidity shall not effect the validity of the remaining provisions of this irdinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared severable. Section 7: Penalty: Any person, firm, association, corporation, or any employee, servant or agent thereof, who shall violate any provisions of this ordinance shall be declared guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than Two hundred ($200.00) Dollars. Each and every violation of the provisions of this ordinance shall constitute a separate offense, and each and every day shall constitute a separate violation, Section 0: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper JI the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
