AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC
USE, AND CLOSING A PORTION OF WINKLER DRIVE ADJA-
CENT TO LOTS 6, 7, 8, 9, 10, 11 AND 12 IN BLOCK 22
OF LAKEWOOD SUBDIVISION, SECTION "D ", AND ABANDON-
ING AND QUITCLAIMING ALL INTEREST OF THE CITY OF
BAYTOWN AND THE PUBLIC IN AND TO SAID PORTION OF
WINKLER DRIVE, AND AUTHORIZING THE MAYOR TO EXECUTE
AND THE CITY CLERK TO ATTEST AND DELIVER A CONVEY-
ANCE TO THE ABUTTING OWNER,
WHEREAS, the following described portion of Winkler Drive adjacent to
Lots 6, 7, B, 9, 10, 11 and 12, in Block 22, of Lakewood Subdivision, Sec-
tion "D ", lying within the corporate limits of the City of Baytown, Harris
County, Texas, according to the Map or Plat thereof recorded in Volume 35,
Page 55, of the Map Records of ilarris County, Texas, is not required by the
public:
That said portion of Winkler Drive that lies East of the
East right of way line of Gulf Pipeline right of way, and
being only that portion of Winkler Drive that is abutted
by Lots 6, 7, 8, 9, 10, 11 and 12, in Block 22 of Lakewood
Subdivision, Section "D ".
WHEREAS, no interest of the Public requires that said portion of Winkler
Drive be improved or kept open, but the needs of the public will be adequately
served by the use of the remaining portion of said Street; and
WHEREAS, the interest of the Public will be benefited by the termination
of any obligation on the part of the City of Baytown to repair, improve and
maintain said portion of Winkler Drive as public way; and
WHEREAS, the only owner of property abutting or adjoining the above
described portion of Winkler Drive has made application that same be discon-
tinued, closed and abandoned; and
WHEREAS, it appears to be to the best interest of the City of Baytown,
Harris County, Texas, that the above described portion of Winkler Drive be
discontinued, closed and abandoned, and it further appears that the interest
of no other owners of property in said Lakewood Subdivision, Section "D" or the
public in general will be prejudiced or impaired thereby, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the above described portion of Winkler Drive adjacent
to Lots 6, 7, 8, 9, 10, 11 and 12 of Block 22 of Lakewood Subdivision, Section
"D ", lying within the corporate limits of the City of Baytown, Harris County,
Texas, be and the same is hereby discontinued and abandoned for Public use, and
the City of Baytown does for itself and for the Public abandon and quitclaim all
interest in and to the above described portion of Winkler Drive, and does hereby
approve the application of said owners of the property abutting said portion of
Winkler Drive.
Section 2: That the Mayor of the City of Baytown is hereby authorized and
directed to execute and the City Clerk to attest and deliver an appropriate con-
veyance of said portion of Winkler Drive to the owner of the property abutting
same.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the
City Council of the City of Baytown, Texas, on this the 2 -2_day of -- --- '
