AN ORDINANCE OF THE CITY C0UNCIL OF THE CITY OF

BE IT ORDkINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN-
Section 1: That an Agency of the City Council of the City of Baytown is
hereby created which shall be known as the Baytown Planning Commission, and that
such Commission shall consist of seven (7) members.
Section 2: Such Commission shall, at all times, have thereon at least one
businessman, one realtor, one attorney and an architect or engineer. Of the Origi-
nal Commission, the latter- mentioned four (4) members shall be appointed for two
(2) year terms and the other three (3) members shall be appointed for one (1) year
terms. Thereafter three members shall be appointed during even numbered years and
four members shall be appointed during odd numbered years; such appointments to co-
incide with the terms served by the City Council members.
Section 3: That as the terms of office of said positions terminate, the
City Council shall, as soon as possible, and at any rate within sixty (60) days after
such expiration, appoint members to fill such vacancies for a term of two years.
The Council, if interim vacancies occur, shill appoint a successor for the remainder
of such term.
Section 4: The Commission may establish its own rules as to the attendance
of its members to its meetings and, in furtherance of such, the Commission may, by
a majority vote, expel any member who, in the opinion of the Commission, misses an
unreasonable number of meetings.
Section 5: The Commission is hereby empowered to establish its own parlia-
mentary procedure; provided that such shall not be in conflict with the law applic-
able to the Commission or the following:
.i quorum shall consist of a majority of the entire
membership of the Commission and any issue to be
voted on shall be resolved by a majority of those
present.
The Chairman shall be entitled to vote upon any
question, but shall have no veto power.
Meetings shall be open to the public and minutes shall be filed with the City
Clerk, and shall be treated as a public record.
Section 6: The Commission shall have the power and shall be required to:
1. Make, amend, extend and add to the master plan for the physical develop -
ment, of the City.
2. The Commission shall study plans and plats of proposed subdivisions
and shall, within legal limits, recommend that such subdivisions
meet with all the standards and requirements as required by the ordin-
ance of the City regulating subdivisions.
3. Draft and recommend to the City Council for its action - an official
map of the City and recommend proposed changes in such map.
4. Make and recommend to the City Council for its action - plans for the
clearance and rebuilding of slum districts and blighted areas which may
develop within the City.
5. Make and recommend to the City Council for its action - a zoning plan
and recommend changes in such plan.
6. Make and recommend to the City Council for its action - highway facilities
and proposed expansions thereof.
7. Review and recommend to the City Council for its action - alterations
to existing building, plumbing, electrical and related codes.
8. Submit annually to the City Manager, not less than ninety days prior to
the beginning of the budget year, a list of recommendations for capital
improvements which, in the opinion of the Commission, are necessary or
desireable to be constructed during the forthcoming five years. Such
list shall be arranged in order of preference, with recommendations as
to the year such improvement should be constructed.
9. Meet not less than once each month. Meetings to be held at the City
Hall, unless notice of change of meeting place be published in a newspaper
of general circulation in the City of Baytown.
10. Perform such other functions as may be duly delegated to them from time
to time by the City Council.
Section 7: That such Baytown Planning Commission is hereby declar6d to be an
adjunct of the City Council. The City Manager and all other administrative personnel
of the City are hereby authorized and directed to cooperate with and assist the Plan-
ning Commission at all reasonable times.
Section 8: Repealing Clause: All ordinances or parts of ordinances inconsis-
tent with the terms of this ordinance are hereby repealed; provided, however, that
such repeal shall be only to the extent of such inconsistency, and in all other re-
spects this ordinance shall be cumulative of other ordinances regulating and govern-
ing the subject matter covered by this ordinance.
Section 9: Savings_ Clause: If any provision, exception, section, sub - section,
paragraph, sentence, clause or phrase of this ordinance or the application of same
to any person or set of circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of the remaining pro-
visions of this ordinance or their application to other persons or sets of circum-
stances and to this end, all provisions of this ordinance are declared to be severable.
INTRODUCED, READ and PISSED by the affirmative vote of a majority of the members
of the City Council of the City of Baytown, on this the 13th day of June, 1%3.
