ORDINANCE NO. 687
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, RECEIVING AND ACCEPTING TEE IZRK
OF CONSTRUCTION OF PERMANENT IMPROVEMENTS WITHIN
THE FOLLOWING DEFINED PORTION OF SOUTH FOURTH
STREET, IN THE CITY OF BAYTOWN; AUThORIZING AND
DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL
ASSESSMENT CERTIFICATES TO GULF BITPULITHTC COlNl-
PANY, THE CONTRACTOR PERFORMING SAID WORK, APPROV-
ING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFI-
CATES; AND PROVIDING FOR THE EFFECTIVE DATE THEhE-
OF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That the work of improving South Fourth Street, from the
South right of way line of East Texas Avenue to the South line of Allen Addition
within the City of Baytown, Texas, by the construction, reconstruction, repairing
or realigning of concrete curbs and gutters, and by the construction of such
drains and other necessary incidentals and appurtenances as deemed necessary by
the City Engineer, and such improvements being as provided for in the Plans and
Specifications therefor which have heretofore been prepared by the City Engineer
and as have been approved and adopted by the City Council; and all of same having
been performed and completed in full compliance with the terms and provisions of
the contract dated November 1, 1962, between said City of Baytown, Texas, and
Gulf Bithulithic Company; and the City Engineer having measured, examined and
caused to be tested the finished improvements by the means and in the manner pro-
vided by the terms of said contract and the Plans and Specifications, and having
found that such improvements have been constructed and completed in full compli-
ance with all provisions of said contract and said Plans and Specifications, and
said City Engineer having approved and accepted said work and improvements and
having heretofore issued his Certificate of Final Acceptance, and so certified to
said City Council and recommended that it accept and receive said work and the
improvements as constructed by said Gulf Bithulithic Company, and said work and
improvements having been examined and found by the Mayor and City Council of said
City of Baytown, Texas, to have been performed and completed in full compliance
with said contract and said Plans and Specifications therefor, and same are here-
by accepted and received by said City Council of the City of Baytown, Texas.
Section 2: That the Mayor and City Clerk of the City of Baytown, Texas,
are hereby authorized and directed to execute and issue to Gulf Bithulithic
Company, Special Assessment Certificates evidencing the assessments levied
against the properties improved abutting upon said portions of South Fourth
Street, and against the real and true owners thereof which, by the terms of
said contract, the City of Baytown, Texas, has agreed and obligated itself to
issue and deliver to said Gulf Bithulithic Company, in accordance with pro-
visions of the relative proceedings heretofore had and adopted by said City
Council; said Special Assessment Certificates to be executed in the name of
said City by its Mayor and City Clerk, and impressed with the seal of said
City, and dated as of the date hereof, and such officers are hereby authorized
and directed to execute said certificates in their official capacities on be-
half of said City, and deliver same to said Gulf Bithulithic Company, said
Special Assessment Certificates having heretofore been prepared and printed,
a copy of which is on file with the City Clerk, the form and contents thereof
being hereby approved and adopted.
Section 3: This ordinance shall take effect from and after the date of
its passage by a majority of the City Council of the City of Baytown.
