AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTO WN PROVIDING FOR MERIT PAY INCREASES FOR CER-
TAIN EMPLOYEES; ESTABLISHING A MERIT RAISE FOND;
CREATING A MERIT RAISE COMMITTEE, ENUMERATING CER-
TAIN STANDARDS THAT SHALL BE CONSIDERED IN GRANTING
OR DENYING MERIT RAISES; PROVIDING MINIMUM AND MAXI -
MUM SALARIES FOR SUPERVISORY EMPLOYEES; REPEALING
ORDINANCES INCONSISTENT HEREWITH, CONTAINING A SAV-
INGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the City Council of the City of Baytown believes in and constantly
strives for greater efficiency in the administration of the City's affairs; and
WHEREAS, the City Council is of the opinion that the officers and employees
of the City should be encouraged to greater efficiency in the performance of their
official duties and that proficient employees should be rewarded therefor; and
WHEREAS, "Merit Raises" is one recognized method of increasing employee pro-
ficiency and rewarding him therefor; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That this ordinance and its provisions shall apply to the officers
and employees generally referred to as "Supervisory Employees ". Such officers and
employees are hereinafter enumerated for greater certainty.
Section 2: That henceforth, at the beginning of each fiscal year, the City
Council shall appropriate a sum of money equal to two (2%) percentum of the total
combined salaries of such supervisory employees. This money shall be placed in a
classification to be known as the "Merit Raise Fund ".
Section 3: There is hereby created a committee which shall be known as the
"Merit Raise Committee ". This committee shall consist of the City Manager, the
Mayor and Councilmen. This committee shall be and is hereby charged with the duty
of administering and effectuating this ordinance.
With the exception of the City Manager, no employee covered by this ordinance
shall receive a raise unless and until same is recommended by the City Manager.
Such recommendation shall be made to the Merit Raise Committee and such raise shall
not be approved without a favorable vote of a majority of the "Merit Raise Commit-
tee" members.
Section 4: The City Manager and the Merit Raise Committee, in granting or
denying merit raises, shall consider the following: (Such enumeration is not in-
tended to exclude other factors).
1. The efficiency of the employee -- particularly in relation to the
past performance of the office.
2. Courtesy and general attitude of the employee toward the public.
3.. Relationship of the employee with other city employees.
4. Imagination and originality of the employee.
5. Special on -,fob training courses or other educational means.
6. The general education and experience factors of the employee.
7. Loyalty of the employee to his superiors and his treatment of his
subordinates.
8. Personal habits and demeanor of the employee.
Section 5: The following positions shall be considered "Supervisory Employees"
for the purpose of this ordinance. The following minimum and maximum salaries shall
serve as a guide under the terms of this ordinance.

No employee shall receive a merit raise more often than each eighteen (18)
months. Merit raises shall not be granted in a sum less than five (50A) percentum
nor more than ten (10%) percentum of the gross salary of the affected employee.
Section 6: Repealing Clause: All ordinances or parts of ordinances inconsis-
tent with the terms of this ordinance are hereby repealed; provided, however, that
such repeal shall be only to the extent of such inconsistency, and in all other re-
spects this ordinance shall be cumulative of other ordinances regulating and govern-
ing the subject matter covered by this ordinance.
Section 7: Savings Clause: If any provision, exception, section, subsection,
paragraph, sentence, clause or phrase of this ordinance or the application of same
to any person or set of circumstances, shall for any reason be held unconstitutional,
void, or invalid, such invalidity shall not affect the validity of the remaining pro,-
visions of this ordinance or their application to other persons or sets of circum-
stances and to this end, all provisions of this ordinance are declared to be sever-
able.
Section S: Effective Date: This ordinance shall take effect immediately upon
its passage.
