Ordinance No. 6730i?DINANCE NO. 673 AN ORDINANCE REGULATING THE WEIGHT OF COMMERCIAL MOTOR VEHICLES, TRUCKS, TRACTORS OR OTHER MOTOR VEHICLES WITH A TRAILER, SEMI - TRAILER OR OTHER VEHICLE ATTACHED THERETO, BEING OPERATED OVER, ON OR UPON CERTAIN STREETS IN THE CITY OF BAYTOWN; PROVIDING FOR ISSUANCE OF A PERMIT UNDER CERTAIN CIRCUMSTANCES; CONTAINING A PENALTY CLAUSE, REPEAL- ING ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR A SEVERABILITY CLAUSE AND SETTING FORTH THE EFFECT- IVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN' Section 1: Statement of Intent and Purpose of Ordinance. It is the intent and purpose of the City Council of the City of Baytown, by the terms of this ordinance to regulate the weight of commercial motor vehicles, trucks or other motor vehicles with trailers, semi - trailers, or other vehicles at- tached thereto being operated over, on or upon certain streets in the City of Baytown as hereinafter set forth. Some of these streets are located in the residential sec- tion of the City and were constructed to have been maintained primarily for light traffic such as the use of automobiles by persons residing in the vicinity thereof. The remainder of the streets are located in the business districts and the highly congested areas of the City of Baytown, where slow, heavy commercial trucks const.- tute a hazard and detriment to traffic. The purpose of this ordinance is to pre . �er:'. the deterioration of residential streets by heavy commercial vehicles and also to promote safe and orderly traffic conditions in the highly congested areas of the City of Baytown. Section 2: That it shall be unlawful for any commercial motor vehicle, truck, tractor or other motor vehicle with a trailer, semi- trailer or other vehicle attache(: thereto, to be operated over, on or upon any street or streets or alleys within the corporate city limits of the City of Baytown, where the weight thereof, together with. the load thereon exceeds _pounds except the hereinafter specifically de- signated streets, to -wit: Bayway Drive - From Decker to Wisconsin. Wisconsin - From end to end. Market Street - From 3400 Block at its intersection with Fenley Street to the "Y" intersection of West Main at Market Street. All of West Main. All of South Main All of Decker Drive All of North fain All of Lee Drive. All of State Highway Rio. 201. All of Airhart. All of State Highway No. 146. Wooster -Cedar Bayou Road from Airhart to Bayway Drive. Provided, however, that the heretofore described vehicles may use the other streets within the City of Baytown in order to fulfill local commercial obligations as per- mission to do so is granted by the Chief of Police or his designated officer. If any applicant for an exception is dissatisfied with the decision of the Chief of Police or his designated officer, then such applicant may appeal to the City Council, and the City Council may reverse or approve the decision of the Chief of Police or his designated officer. Section 3: Exceptions: The provisions of this ordinance shall not apply to buses operated by the Goose Creek Independent School District or by any person, firm or corporation having a franchise from the City to engage in the business of public transportation. Section 4: Penalt : Any person, firm or corporation violating the provisions of Section 2 hereof shall, upon conviction, be deemed guilty of a misdemeanor and fined not exceeding Two Hundred ($200.00) Dollars. Section 5: Repealing Clause: All ordinances or parts of ordinances inconsis- tent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and gov- erning the subject matter covered by this ordinance. Section 6: Severability Clause-: If any provision, exception, section, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held uncon- stitutional, void, or invalid, such invalidity shall not effect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared ti be severable. Section 7: Effective Date: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby d.- rected to give notice hereof by causing the caption of this ordinance to be publi0'�­ in the official newspaper of the City of Baytown at least twice prior to the effect- ive date thereof.
