BE IT CADAIN2D BY THE CITY COUNCIL OF THE CITY OF BAYTG",JN: Section 1: Intent & ' „rpose of this ordinance,_ The City Council of the City of Be.ytown, acting }pursuant to Article 1, Nection 9, of the Charter of said City hereby declares that it is necessary that the existing boundary limits of tha City be extended to include the hereinafter described territory lying adjacent to the City and that the existing* boundary limits of the City be extended to in- elude such territory. The purpose and intent of this extension of the boundary ,r4!- 1. limits of the City of Baytown is to take care of said City's present needs for additional territory and the reasonably anticipated future growth and expansion of the City. Section 2; That the boundary limits of the City of Baytown, Texas, be enlarged and extended as hereinafter set out so as to include within the boundary limits of said City, all that territory adjacent to said City within the following described lines, to -wit: BEGINNING at the point of intersection of the mean high tide line of the Easterly shore of Black Duck Bay with a line which is parallel to and 200 feet South of the South right of way line of State Highway No. 146; THENCE, Easterly -- following a line which is parallel to and 200 feet Southerly from the South right of way line of State Highway No. 146 to Causeway Road and continuing over and across said Causeway Road to the East right of way line of Causeway Road; THENCE, Southerly - with the East right of way line of Causeway Road at the North right of way line of Evergreen Road; THENCE, Easterly - Southeasterly and Northeasterly with the North right of way line of Evergreen [toad to the West right of way line of Tri -City Beach Road; THENCE, Northwesterly - over and across the Tri -City Beach Road to the Westerly right of way line of Tri -City Beach Road; THENCE, Southerly - following the Easterly right of way line of Tri -City Beach Road to the South line of a 326.50 acre tract of land owned by J. H. Phalen, A. Al. Phalen, Randolph Mead and D'Arcy M. Cashin; THENCE, Northeasterly - with the South line of the abovementioned tract to the Southeast corner of the said tract, said corner being located in the Westerly shore of Cedar Bayou Stream at the Bayou Bend known as "Devil's Elbow "; THEME, downstream - following the meanders of the mean high tide line of the Westerly shore of Cedar Bayou Stream to the point of intersection with the mean high tide line of the North shore of Negro Read Lake; THENCE, Northerly, Westerly, Southerly, Easterly and Northerly with the mean high tide line of Negro Head Lake to the mean high tide line of Cedar Bayou Stream; THENCE, downstream - following the meanders of the mean high tide line of the Westerly shore of Cedar Bayou Stream to the point of intersection with the mean high tide line of the Northerly shore of Ash Lake; THENCE, Northwesterly, Southerly, Westerly and Easterly - follow- ing the mean high tide line of the shoreline of Ash Lake and Cedar Bayou Stream to the point of intersection of said Westerly shore- line with the Northeasterly shoreline of Galveston Bay; THENCE, in a Northerly and Westerly direction - following the mean high tide line of the shoreline of Galveston Bay and Tabb's Bay to the East shoreline of Goose Creek Stream; THENCE, continuing Westerly - over and across the mouth of Goose Creek Stream to the point of intersection of the West shoreline of Goose Creek Stream with the mean high tide line of the North- erly shoreline of Black Duck Bay; THENCE, continuing with said shoreline of Black Buck Bay - to the PAINT OF BEGINNING. Section 3: That the above described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said City shall bear its pro rata part of the taxes so levied by the City of Baytown and the inhabit- ants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, regulations and provisions of the Charter of the City of Baytown. Section 4: That if any portion or portions of the above described territory is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the remaining ter- ritory is hereby annexed to the City of Baytown, and the boundary limits of said City are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section 5: That if any portion or portions of the above described territory may become included within the limits of another city or town, by reason of a valid annexa- tion ordinance heretofore introduced before the council, commission or other governing body of such city or town, then such portion or portions of the above described terri- tory is hereby excluded from the limits of the City of Baytown and the remaining terri- tory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section 6: That if any legal impediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such por- tion of the above territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are here- by amended to conform to the territory so annexed. Section 7: If any provision, exception, section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circum- stances or to any particular tract or parcel of land, shall for any reason be held un- constitutional, void or invalid, such invalidity shall not affect the validity or the remaining provisions of this ordinance or their application to other persons or sets of circumstances or to other tracts or parcels of land included in the territory herein - above described in Section 2 of this ordinance. Section B: That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article 1, Section 9, of the Charter of the City of Baytown.
