AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN PROVIDING THAT EMPLOYEES OF THE CITY OF
BAYTOWN MAY LIVE WITHOUT THE CORPORATE LIMITS OF
THE CITY OF BAYTOWN IF PERMISSION IS FIRST GRANTED;
PROVIDING RULES AND REGULATIONS FOR SUCH PERMISSION;
REPEALING ORDINANCES INCONSISTENT THEREWITH, CON-
TAINING A SAVINGS CLAUSE AND PROVIDING FOR THE EF-
FECTIVE DATE THEREOF.
WHEREAS, the City of Baytown is a "Home Rule" City and the Constitution
of the State of Texas does not require that employees of a "Horne Rule" City
reside within its Corporate Limits; and
WHEREAS, the Texas Legislature has never required employees of "dome Rule"
cities to maintain residence within their corporate limits; and
WHEREAS, the City Charter of the City of Baytown is silent as to residence
requirements of its employees, with the exception of the City Manager; and
WHEREAS, from time to time, an oG04sional'employee -of the City;,,of.Baytow>-
for various reasons, desires to live without the Corporate Limits of Baytown;
and
WHEREAS, the City Council of the City of Baytown is of the opinion that
employees should be permitted to live outside the confines of the City of Baytown
if such permission is judicially supervised and regulated; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That hereafter, any employee of the City of Baytown, not other-
wise effected by law, shall have the right to live outside the City Limits; pro-
vided that:
(1) Such employee shall first obtain permission from the City
Manager. (Should the City Judge wish to live outside the
City of Baytown, written permission shall be obtained from
the City Council).
(2) The City Manager shall take into consideration the nature and
type of work performed by the employee and whether or nat such
employee is subject to emergency call,

(3) The City Manager will take into consideration the distance an
employee may live from the City Limits and /or his place of em-
ployment. The City Manager shall administer this ordinance to
the end that relatively few employees shall live outside the
City of Baytown and that such permission shall only be permitted
where there is a distinct advantage to the employee and no dis-
advantage to the citizens of Baytown.
(4) The City Manager shall have the right to require the employee to
have a telephone.
(5) The City Manager may impose other requirements and restrictions
and may grant or deny permission at his sole discretion.
Section 2: The City Council reserves the right to amend or repeal this
ordinance provided that such amendment or repeal shall not effect the status of
any employee who duly moves outside the City Limits on the basis of this ordinance
Section 3: Repealing Clause: All ordinances or parts of ordinances incon-
sistent or in conflict with the provisions of this ordinance shall be and the
same are hereby repealed.
Section 4-:. Savings Clause: In the event any section, sub - section, sen-
tence, clause or phrase of this ordinance shall be declared or adjudged invalid
or unconstitutional, such adjudication shall in no means effect any other sections
sub - sections, sentences, clauses or phrases of this ordinance, but all the rest
thereof shall be in full force and effect as though the section, sub - section,
sentence, clause or phrase so declared or adjudged invalid or unconstitutional
was not originally a part thereof.
Section 5: Effective bate: This ordinance shall take effect from and
after its passage by a majority of the City Council of the City of Baytown, Texas.
