AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, RECEIVING AND ACCEPTING THE WORK
OF CONSTRUCTION OF PERMANENT .PAVING AND OTHER IM-
PROVEMENTS WITHIN THE FOLLOWING DEFINED PORTION OF
WEST MAIN STREET (FORMERLY KNOWN AS GOOSE- CREEK-
PELLY ROAD) IN THE CITY OF BAYTOWN; AUTHORIZING AND
DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL AS-
SESSMENT CERTIFICATES TO BROWN AND ROOT, INC., THE
CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM
OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND PROVID-
ING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That the work of improving West Main Street (formerly known
as Goose - Creek -Pelly Road), from the West right -of -way line of McKinney Street
(7th Street), also being the East line of Block Seven (7) of Jones Addition to
the City of Pelly (now Baytown), to a point Sixty -Five (651) Feet Westerly from
the West line of Allman Street (6th Street), in the City of Baytown, Texas, by
widening the existing Twenty (20') Foot Concrete Slab Street to Fifty -One (51')
Feet - back to back of curb, by using cement stabilized shell base, asphaltic
concrete surfacing, curb and gutter, and other incidentals, all as provided by
the plans and specifications therefor which have heretofore been prepared by the
City Engineer and as have been approved and adopted by the City Council; and all
of same having been performed and completed in full compliance with all the terms
and provisions of the contract dated December 14, 1961, between said City of Bay-
town, Texas, and Brown & Root, Inc.; and said City Engineer, having measured,
examined and caused to be tested the finished improvements by the means and in
the manner provided by the terms of said contractor and the plans and specifica-
tions, and having found that such improvements have been constructed and com-
pleted in full compliance with all provisions of said contract and said plans
and specifications, and said City Engineer having approved and accepted said work
and improvements and having heretofore issued his Certificate of Final Acceptance,
and so certified to said City Council and recommended that it accept and receive
said work and the improvements as constructed by said Brown & Root, Inc., and
said work and improvements having been examined and found by the Mayor and City
Council of said City of Baytown, Texas, to have been performed and completed in
full compliance with said contract and said plans and specifications therefor,
and same are hereby accepted and received by said City Council of the City of
Baytown, Texas.
Section 2: That the Mayor and City Clerk of the City of Baytown, Texas,
are hereby authorized and directed to execute and issue to Brown & Root, Inc.,
Special Assessment Certificates evidencing the assessments levied against the
properties improved abutting upon said portions of West Main Street, and against
the real and true owners thereof, which, by the terms of said contract, the City
of Baytown, Texas, has agreed and obligated itself to issue and deliver to said
Brown & hoot, Inc., in accordance with provisions of the relative proceedings
heretofore had and adopted by said City Council; said Special Assessment Certifi-
cates to be executed in the name of said City by its Mayor and City Clerk, and
impressed with the seal of said City, and dated as of the date hereof, and such
officers are hereby authorized and directed to execute said Certificates in their
official capacities on behalf of said City, and deliver same to said Brown & Root,
Inc., said Special Assessment Certificates having heretofore been prepared and
printed, a copy of which is on file with the City Clerk, the form and contents
thereof being hereby approved and adopted,
Section 3: This ordinance shall take effect from and after the date of its
passage by a majority of the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by a majority of the City Council of the City
of Baytown, Texas, on this the 17th day of April, 1962.
