AN ORDINANCE CREATING THE BAYTOWN ZONING COMMISSION;
PRESCRIBING THE NUMBER, DUTIES AND QUALIFICATIONS OF ITS
MEMBERS AND THEIR TERM OF OFFICE; PROVIDING FOR THE AP-
POINTMENT OF ITS MEMBERS AND THE METHOD OF FILLING VACAN-
CIES; MAKING DEPARTMENT HEADS AND OFFICIALS AVAILABLE TO
SUCH COMMISSION; PRESCRIBING POWERS AND DUTIES OF THE ZON-
ING COMMISSION; PROVIDING FOR ADOPTION OF RULES, REGULA-
TIONS AND BYLAWS; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES INCONSISTENT HERETO; PROVIDING A SAVINGS CLAUSE
AND THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: There is hereby created and established within the City of
• Baytown, Texas, a Zoning Commission which shall be composed of seven (7) members
whose offices are hereby created and established. The members of the Zoning Com-
mission shall be resident citizens of the City of Baytown, real property owners,
taxpayers and qualified voters of Baytown. The term of office of said members
shall be two (2) years; provided however, at the first meeting of the first seven
(7) members of the Zoning Commission, such members shall draw by lot to determine
which four (4) members shall serve for two year terms and thereafter, on odd num-
bered years, four (4) members shall be appointed for a full term of two (2) years.
The remaining three (3) members shall serve for a term of one (1) year and there-
after, on even numbered years, three (3) members shall be appointed for a full two
(2) year term. After the appointment of the original members thereof all vacancies
occurring in the Zoning Commission shall be filled by appointment by the City Coun-
cil for the remainder of such term.
Section 2: That the Zoning Commission shall not employ any employees nor in-
cur any substantial expense until such is presented to the City Manager and ap-
proved by the City Council. Any and all substantial expenditures and salaries of
consultants or other employees must be approved and fixed by the City Council.
Section 3: All Department Heads and Officials of the City of Baytown shall
be available to the Zoning Commission for advice and consultation and they shall
cooperate with and render such services for the Zoning Commission as shall come
• within the scope of the duties of such Department Heads and Officials. All such
Department Heads and Officials shall attend meetings of the Zoning Commission upon
the request of the Zoning Commission.

Section 4: The Zoning Commission shall have the power and authority and it
shall be its duty to formulate a plan to regulate and restrict the location of trades
and industries and the location of buildings designed for specific uses, and also
regulate and limit the height and bulk of buildings hereafter erected and, to effect
such purposes, divide the City into aones'of such numbers, shape and area as may
seem best to carry out a definite plan for the betterment of the City and to submit
same to the City Council for its approval, amendment or rejection. In performing
such duties the Commission shall function as provided under Articles 1011a to 1011j,
:Revised Civil Statutes of the State of Texas.
Section 5: Said Zoning Commission shall, subject to the approval of the City
• Council, make such rules and regulations and adopt such bylaws for its own govern-
meet and designate such time and places for holding regular meetings as it deems
proper. Four (4) members of the Zoning Commission shall constitute a quorum for
transaction of business.
Section 6: Repealing Clause: All ordinances or parts of ordinances inconsis-
tent or in conflict with the provisions of this ordinance shall be and the same are
hereby repealed.
• Section 7: Savings Clause: If any provision, exception, section, subsection,
paragraph, sentence, clause or phrase of this ordinance or the application of same
to any person or set of circumstances, shall for any reason be held unconstitutional,

void or
invalid,
such invalidity shall not affect
the validity
of
the remaining pro-
visions
of this
ordinance or their application to
other persons
or
sets of circum-
stances and to this end, all provisions of this ordinance are declared to be sever-
able.
Section 8: Effective Date: This ordinance shall take effect from and after
the date of its passage.
INTRODUCED, READ and PASSED by the affirmative vote of a majority of the City
Council of the City of Baytown, on this the 14th day of December, 1961.
