Ordinance No. 635n U • ORDINANCE NO. 635 AN ORDINANCE PROVIDING THAT ALL EMPLOYEES OF ALL DEPARTMENTS, INCLUDING THE CITY MANAGER, OF THE CITY OF BAYTOWN SHALL HEREBY AND HERE- AFTER PARTICIPATE IN THE MUNICIPAL RETIREMENT SYSTEM; REPEALING ORDINANCES INCONSISTENT HERE- WITH; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby elects to have all City employees of all departments, including the City Manager, to participate in the Texas Municipal Retirement System as provided for in Article 6243h of Vernon's Annotated Civil Statutes, as amended, and all the benefits and obligations of such system are hereby accepted. Section 2: That the City Manager is hereby directed to notify the Board of Trustees of the Texas Municipal Retirement System that the City of Baytown, Texas, has elected to participate and have the employees of the following de- partments and offices participate in such System: City Manager, City Clerk, City Recorder, Fire Marshal, Technical Inspection, Finance, Police, Fire, Pub- lic Works, Health, Recreation, Water, Law, Engineering and Library. Section 3: That each person who becomes an employee of any participating department on or after the effective date of participation of such department shall be included within and subject to the provisions of the Texas Municipal Retirement System beginning upon the date such person becomes an "employee" as defined in subsection 14, Section 2 of such System. Section 4: That the City of Baytown, Texas, may in the future refuse tp add new departments or new employees to such System, but it shall never discon- tinue as to any participants. V Section 5: That the City Clerk is hereby directed to remit to the Board of Trustees of the Texas Municipal Retirement System, at its office in Austin, Texas, the City's proper contributions to the System and the amounts which shall be deducted from the compensation or payroll of employees, all as required by said Act creating said Retirement System. Section 6: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such re- peal shall be only to the extent of such inconsistency, and in all other , • respects this and governing Section sentence, cla, person or set • • ordinance shall be cumulative of other ordinances regulating the subject matter covered by this ordinance. 7: If any provision, exception, section, sub - section, paragraph, use or phrase of this ordinance or the application of same to any of circumstances shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 8: That this ordinance shall take effect immediately upon its adoption by a majority of the City Council of the City of Baytown.
