ORDINANCE NO. 632
AN ORDINANCE ASSESSING A FEE FOR SANITARY SEWER
SERVICE AND PROVIDING A METHOD OF CHARGING AND
COLLECTING SUCH FEE; REPEALING ORDINANCES INCON-
SISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE &
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, one of the primary functions and responsibilities of the City of
Baytown is to provide Sanitary Sewer Service for its citizens; and
WHEREAS, many major additions and improvements have been made to Baytown's
Sanitary Sewer System in recent years; and
WHEREAS, sound business management dictates that the City of Baytown makes a
nominal charge for such service; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That henceforth the City of Baytown shall charge as a Sanitary

Sewer Service fee the sum of One ($1.00) Dollar a month fornevery residence, dwell-
ing, apartment, business or other enterprise of whatsoever nature and description,
which is furnished Sanitary Sewer Service.
Section 2: That said charge or fee for such Sanitary Sewer Service shall be
and is hereby levied by the City of Baytown against all owners, occupants, tenants
and lessees using or occupying such residence, dwelling, apartment, business or
other enterprise of whatsoever nature and description. It is deemed necessary that
this charge be levied as provided in order to provide and maintain proper Sanitary
Sewer Service essential to the preservation of public health and safety. Any per-
son who shall fail or refuse to pay the charge herein specified within thirty (30)
days from the date same shall become due and payable shall have his service sus-
pended, and the City Health Officer shall be notified immediately for appropriate
action in accordance with the ordinances and laws regulating sanitation.

at
no charge;
and

Section 3: For convenience of collection, it is provided that this charge
• shall be added to the monthly water bills prepared and mailed by the City's Water
Department, and collection of said charge shall be made by that department. The
owner, occupant, tenant and lessee from which water is so collected by the City
shall pay the One ($1.00) Dollar charge therefor at the time of payment of the mon-
thly water bill covering service to such residence, dwelling, apartment, business
or other enterprise of whatsoever nature and description. After such charge has
been made, employees of the City shall not accept payment of the monthly water bill
from any such owner, occupant, tenant and lessee without collecting the full amount
of said bill including the Sanitary Sewer charge.
• Section 4: All ordinances or parts of ordinances inconsistent or in conflict
with the terms of this ordinance are hereby repealed; provided, however, that such
repeal shall be only to the extent of such inconsistency, and in all other respects
this ordinance shall be cumulative of other ordinances regulating and governing the
subject matter covered by this ordinance.
Section 5: If any provision, exception, section, sub - section, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any per-
son or set of circumstances shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions
of this ordinance or their application to other persons or sets of circumstances,
• and to this end all provisions of this ordinance are declared to be severable.
Section 6: That this ordinance shall take effect from and after the date of
its passage by a majority of the City Council of the City of Baytown, Texas.
