Ordinance No. 627® ORDINANCE NO. 627 AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND PASS- AGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE 1, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN, BE IT ORDAINED BY THE,CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: Intent and Pur ose of this Ordinance: The City Council of the El territory lying adjacent to the City be annexed and the existing boundary limits of the City be extended to include such territory. The purpose and intent of this extension of the boundary limits of the City of Baytown is to take care of said City's present need for additional territory and the reasonably anticipated future growth and expansion of the City. Section 2: That the boundary limits of the City of Baytown, Texas, be en- larged and extended as hereinafter set out so as to include within the boundary limits of said City all that territory lying adjacent to said City within the fol- lowing described lines, to -wit: T R A C T - A BEGINNING at the point of intersection of the Easterly line of Bay Villa Subdivision in the William Scott Upper League, and the North- easterly shore of Scott's Bay, said point of intersection being situ- ated South 31 degrees 46 minutes West 460.9 feet from the Northwest corner of Bay Villa Addition, said corner being located in the South- westerly right -of -way line of Market Street Road; THENCE, in a Westerly direction along the shore line of Scott's Bay at mean high tide to the Southwest corner of Lot 10, Block K, in the town of Wooster; THENCE, Northwesterly along the West line of Lot 10, Block K, in the town of Wooster to the Northeast corner of Lot 9, in Block K, of the town of Wooster; THENCE, in a Southwesterly direction along the South line of Block K, in the town of Wooster to the Southwest corner of said Block K; 19 THENCE, continuing on an extension of the South line of Block K, of the town of Wooster to the intersection of a line which is 2500 feet Easterly at right angles from and parallel to the centerline of the Houston Ship Channel; City of Baytown, acting pursuant to Section 9, of Article 1, of the Charter of said City, hereby declares that it is necessary that the hereinafter described El territory lying adjacent to the City be annexed and the existing boundary limits of the City be extended to include such territory. W. Singleton Survey; THENCE, Northerly along the said West line of the J. W. Singleton Sur- vey to the Northwest corner of said Survey; THENCE, Easterly along the North line of said J. W. Singleton Survey to the Northeast corner of said Survey; THENCE, continuing on a line which is the South line of the Benjamin J. Barrow Survey and the North line of the D. M. McFadden Survey.3to the intersection of said line with the mean high tide line of the West bank of Cedar Bayou; THENCE, Southerly with the meanders of the mean high tide line of the Westerly shore of Cedar Bayou Stream to the most Easterly Northeast corner of a 41.23 acre tract of land owned by the City of Baytown, said tract of land described in deed recorded in Volume 4226 at Page 116 of the Deed Records of Harris County. Texas; THENCE, with the North line of the City of Baytown's tract, South 81 degrees 04 minutes 20 seconds West a distance of 709.08 feet; South 82 degrees 20 minutes 40 seconds West a distance of 569.95 feet; North 63 degrees 15 minutes 42 seconds West a distance of 297.86 feet; and North 74 degrees 23 minutes 33 seconds West a distance of 484.37 feet to a Northwest corner of the City of Baytown's tract of land; THENCE, with a Westerly line of the City of Baytown's tract, South it degrees 50 minutes 9 seconds West a distance of 423.29 feet to an in- terior corner of the City of Baytown's tract; THENCE. continuing to follow the boundary line of the City of Baytown's tract, South 35 degrees 14 minutes 41 seconds West a distance of 108.97 feet; North 11 degrees 50 minutes 09 seconds East a distance of 96.91 feet; and South 82 degrees 54 minutes 28 seconds West a distance of 275.76 feet to the most Westerly Northwest corner of the City of Baytown's 41.23 acre tract of land, said corner located in the Easterly right -of- way line of Cedar Bayou Road; THENCE, continuing Westerly over and across Cedar Bayou Road to the Westerly right -of -way line of Cedar Bayou Road; THEME, Southerly with the Westerly right -of -way line of Cedar Bayou Road to the centerline of Pond's Gully; THENCE, upstream in a Northwesterlr�i ection with the meanders of the centerline of Pond's Gully to the line of the J. T R A C T- B • BEGINNING at the most Southerly Southeast corner of a 41.23 acre tract of.land owned by the City of Baytown, said tract of land described in deed recorded in Volume 4226 at Page 116 of the Deed Records of Harris County, Texas, said point of beginning located on the mean high tide line of the Westerly shore of Cedar Bayou Stream; THENCE, following the boundary lines of the City of Baytown's tract of land, North 53 degrees 38 minutes 23 seconds West a distance of 441.41 feet; North 75 degrees 14 minutes 47 seconds West a distance of 143.16 feet; North 03 degrees 03 minutes 28 seconds East a distance of 252.85 feet; North 72 degrees 25 minutes 41 seconds West a distance of 329.18 feet; and North 75 degrees 35 minutes 53 seconds West a distance of 421.25 feet to the Easterly right -of -way line of Cedar Bayou Road, being the most Westerly Southwest corner of the City of Baytown's tract; THENCE, Southerly along the Easterly right -of -way line of Cedar Bayou Road to the most Westerly Northwest corner of the Cedar Bayou Methodist Church property, also being the Southwest corner of a 4.52 acre tract of land owned by the Cedar Bayou Masonic Lodge; THENCE, Easterly, Southerly, Easterly, Northerly, Easterly, and South- easterly following the Northerly boundary line of the Cedar Bayou (Methodist Church property to the mean high tide line of the Westerly shore of Cedar Bayou Stream, being the most Easterly Northeast corner of the Cedar Bayou Methodist Church property; THENCE, upstream in an Easterly and Northerly direction, following the meanders of the Westerly shore of Cedar Bayou Stream to the POINT OF BE- GINNING. -5- Section 3: That the above described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said City shall • bear its pro rate part of the taxes levied by the City of Baytown and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, regulations and provisions of the Charter of the City of Baytown. Section d: That if any portion or portions of the above described territory is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the re- maining territory is hereby annexed to the City of Baytown, and the boundary limits of said City are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Sect_ ion 5: That if any portion or portions of the above described territory . legally may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the council, commission or other governing body of such city or town. then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section b: That if any legal impediment exists preventing the valid annexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining terri- tory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the territory so annexed. Section 7: If any provision, exception, section, paragraph, sentence, clause • or phrase of this ordinance or the application of same to any person or set of cir- cumstances or to any particular tract or parcel of land, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances or to other tracts or parcels of land included in the territory hereinabove described in Section 2 of this ordinance. Section 6: That this ordinance upon and after its introduction shall be pub- lished and finally acted upon in the manner provided in Article 1, Section 9, of the Charter of the City of Baytown.
