Ordinance No. 6160 K] • s • 616 ORDINANCE NO is AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PER- MANENT PAVING AND OTHER IMPROVEMENTS WITHIN THE FOLLOWING DEFINED PORTION OF CARNEGIE STREET, IN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE -OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC., THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND PROVIDING FOR THE EF- FECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the work of improving Carnegie Street, from the South property line of Lindberg Street to the North line of the Missouri Pacific Rail- road right -of -way, within the City of Baytown, Texas, by raising, grading, fill- ing, widening, permanently paving and repaving same, and by the construction re- construction, repairing or realigning of concrete curbs and gutters, and by the construction of such drains and other necessary incidentals and appurtenances as deemed necessary by the City Engineer, said permanent paving consisting of cement stabilized shell base and hot mix asphaltic concrete, of such type, construction, materials and thickness as deemed adequate and suitable by the City Engineer, and all of said improvements being as provided for in the Plans and Specifications therefor which have heretofore been prepared by the City Engineer and as have been approved and adopted by the City Council; and all of same having been performed and completed in full compliance with all the terms and provisions of the contract dated November 25, 1959, between said City of Baytown, Texas, and Brown & Root, Inc.: and said City Engineer having measured, examined and caused to be tested the fin- ished improvements by the means and in the manner provided by the terms of said contract and the Plans and Specifications, and having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said Plans and Specifications, and said City Engineer having approved and accepted said work and improvements and having heretofore issued his Certifi- cate of Final Acceptance, and so certified to said City Council and recommended that it accept and receive said work and the improvements as constructed by said Brown G Root, Inc., and said work and improvements having been examined and found by the Mayor and City Council of said City of Baytown, Texas, to have been per- formed and completed in,'full compliance with said contract and said Plans and Spedi- fications therefor, and same are hereby accepted and received by said City Council of the City of Baytown, Texas. 0 LJ u1 Is i Section 2: That the Mayor and City Clerk of the City of Baytown, Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc., Special Assessment Certificates evidencing the assessments levied against the properties improved abutting upon said portions of Carnegie Street, and against the real and true owners thereof, which, by the terms of said contract, the City of Baytown, Texas, has agreed and obligated itself to issue and deliver to said Brown & Root, Inc., in accordance with provisions of the relative proceedings heretofore had and adopted by said City Council; said Special Assessment Certificates to be executed in the name of said City by its Mayor and City Clerk, and impressed with the seal of said City, and dated as of the date hereof, and such officers are hereby author- ized and directed to execute said certificates in their official capacities on be- half of said City, and deliver same to said Brown & Root, Inc., said Special Assess- ment Certificates having heretofore been prepared and printed, a copy of which is on file with the City Clerk, the form and contents thereof being hereby approved and adopted. Section. 3: This ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown.
