C J ® AN ORDIlONCE OF THE CITY COUNCIL OF THE CI'T'Y OF BA1"IOWN2 TEXAS, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PERNriANENT PAVING AND OTHER Iii MOVEMENTS WITHIN THE FOLLOWING DEFINED PORTIONS OF SOUTH i& IN STMET IN THE CITY OF BAYTOWN; AUTHOR- IZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC., THE CONTRACTOR PERFORMING SAID WOhK; APPROV- ING THE FORM OF SUCH SPECIAL ASSESS14ENT CERTIFICATES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTO[dN: Section 1: That the work of improving South Main Street from the south property line of East Republic Street to Alexander Drive, within the City of • Baytown, Texas, by raising, grading, filling, widening, permanently paving and repaving same, and by the construction, reconstruction, repairing and realigning of concrete curbs and gutters, and by the construction of such drains and other necessary incidentals and appurtenances as deemed necessary by the City Engineer, said permanent paving consisting of reinforced concrete pavement upon a properly prepared subgrade, of such type, construction, materials and thickness as deemed adequate and suitable by the City Engineer, and all of said improvements being as provided for in the Plans and Specifications therefor which have heretofore been prepared by the City Engineer and as have been approved and adopted by the City Council; and all of same having been performed and completed in full accordance with all the terms and provisions of the contract dated July 23, 1959, between • said City of Baytown, Texas and Brown & Root, Inc., and said City Engineer having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of said contract and the Plans and Speci- fications, and having found that such improvements have been constructed and corn- plated in full compliance with all provisions of said contract and said Plans and Specifications, and said City Engineer having approved and accepted said work and improvements and having heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommended that it accept and receive said work and the improvements as-constructed and completed by said Brown & Root, Inc., and said work and improvements having been examined and found by the mayor • and City Council of said City of Baytown, Texas, to have been performed and com pleted in fill compliance with said contract and said Plans and Specifications • therefor, and same are hereby accepted and received by said City Council of the City of Baytown, Texas. Section 2. That the Mayor and City Clerk of the City of Baytown., Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc., Special Assessment Certificates evidencing the assessments levied against the properties improved abutting upon said portions of South Yhin Street and against the real and true owners thereof, which, by the terms of said contract, the City of Bay- town, Texas, has agreed and obligated itself to issue and deliver to said Brown & Root, Inc., in accordance with provisions of the relative proceedings heretofore had and adopted by said City Council; said Specia-AL Assessment Certificates to be • executed in the name of said City by its mayor and City Clerk, and impressed with the seal of said City, and dated as of the date hereof, and such officers are here- by authorized and directed to execute said certificates in their official capaci- ties on behalf of said City, and deliver same to said Brown & Root, Inc., said Special Assessment Certificates having heretofore been prepared and printed, a copy of which is on file with the City Clerk, the form and contents thereof being hereby approved and adopted. Section 3. This ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown.
