Ordinance No. 600-A0 ORDINANCE NO. 600-A AN ORDINANCE CONTAINING ORDINANCE NO. 600, INTRODUCED THE 22ND DAY OF JUNE, 1960, AND BEING: "AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HERE- IN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN "; PROVIDING FOR THE AMENDMENT OF SAID ORDINANCE NO. 600 WITH RESPECT TO THE TERRITORY TO BE ANNEXED AND FOR THE FINAL PASSAGE OF SAID ORDINANCE IN AMENDED FORA PURSUANT TO SECTION 9, ARTICLE I, OF THE CHARTER OF THE CITY OF BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That pursuant to Section 9, Article I, of the City Charter, said Ordinance No. 600, introduced to the City Council of the City of Baytown, on the twenty- second (22nd) day of June, 1960, shall be amended and so amended shall read as follows: ORDINANCE NO. 600 AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: Intent G Purpose of this Ordinance: The City Council of the City of Baytown, acting pursuant to Section 9, Article I, of the Charter of said City, hereby declares that it is necessary that the existing boundary limits of the City be extended to include the hereinafter described territory lying adjacent to the City and that the existing boundary limits of the City be extended to include such territory. The purpose and intent of this extension of the boundary limits of the City of Baytown is to take care of said City's present needs for additional terri- tory and the reasonably anticipated future growth and expansion of the City. Section 2: That the boundary limits of the City of Baytown, Texas, be en- larged and estended as hereinafter set out so as to include-within the boundary limits of said City, all that territory adjacent to said City within the following described lines, to -wit: t A1 Tract - A• BEGINNING at the Northwest corner of a 47.81 acre tract of land conveyed to Defense Plant Corporation by Humble Oil G Refining Company, said 47.81 acre tract now being a part of the property owned by United Rubber and Chemical Company; THENCE, from the point of beginning, South 21 degrees 10 minutes West 551.92 feet to an inner corner of said 47.81 acre tract; THENCE, South 20 degrees 56 minutes West 710.92 feet, per- pendicular 100 feet distance from the East line of the Sweeney Subdivision, along the West line of said 47.81 acre tract, to the Southwest corner of said 47.61 acre tract, said corner being situated Easterly 100 feet from the East line of Sweeney Subdivision; THENCE, North 32 degrees 18 minutes East into the private pro - perty of the aforesaid Humble Baytown Plant site with a line parallel to and 1.04 feet Easterly from the centerline of a private road identified as East Avenue and its Southern pro- jection for a distance of 1795.04 feet to the centerline of a private road identified as Humble Street; THENCE, North 57 degrees 42 minutes West with the aforesaid centerline of Humble Street, 1043.49 feet to the centerline of a private road identified as Baytown Avenue; THENCE, North 32 degrees 18 minutes East with the aforesaid centerline of Baytown Avenue, 1636.17 feet to the centerline of a private road identified as Fannin Street within the Bay- town Refinery property; THENCE, South 87 degrees 44 minutes East with the South iine of the said 47.81 acre tract a distance of 579.54 feet; THENCE, North 2 degrees 16 minutes East a distance of 739 feet; THENCE, South 87 degrees 44 minutes East a distance of 701.50 feet; THENCE, North 2 degrees 16 minutes East a distance of 461 feet to the North line of the said 47.61 acre tract; THENCE, North 67 degrees 44 minutes West a distance of 674 feet to the POINT OF BEGINNING. Tract - B: BEGINNING at the point of intersection of the West right -of- way line of Harbor Street with the North line of the Houston Lighting & rower Company tract in the City of Baytown, Wm. Scott Upper League, Harris County, Texas, said POINT OF BEGIN - NING being further described as situated South 32 degrees 19 minutes West a distance of 49.5 feet from the point of inter- ® section of the aforesaid street West right -of -way line and the North right -of -way line of Dayton Street, and said point of 'intersection of said streets described as lying North 20 de- grees 28 minutes West a distance of 74.6 feet from the North- west corner of Block 1 in Airhart Addition, Wm. Scott Upper League, Harris County, Texas, and said point of intersection 'of the aforesaid street property lines being known as point !No. 35 in the City Limits of Baytown, formerly Pelly, as 'adopted by the City Council by Ordinance dated April 17, 1947, said point of intersection being further identified by the Humble Refinery Coordinate System as being North 5974.95 and West 1026.11 and lying on the Southern boundary line of the Humble Oil & Refining Company Baytown Refinery Plant Site; THENCE, North 32 degrees 18 minutes East into the private pro - perty of the aforesaid Humble Baytown Plant site with a line parallel to and 1.04 feet Easterly from the centerline of a private road identified as East Avenue and its Southern pro- jection for a distance of 1795.04 feet to the centerline of a private road identified as Humble Street; THENCE, North 57 degrees 42 minutes West with the aforesaid centerline of Humble Street, 1043.49 feet to the centerline of a private road identified as Baytown Avenue; THENCE, North 32 degrees 18 minutes East with the aforesaid centerline of Baytown Avenue, 1636.17 feet to the centerline of a private road identified as Fannin Street within the Bay- town Refinery property; a 0 0 "3" THENCE, North 57 degrees 42 minutes West with the aforesaid centerline of Fannin Street, 1075.40 feet to the centerline of a private roadway identified as San Jacinto Avenue; THENCE, North 32 degrees 18 minutes East 1794.00 feet to the centerline intersection of the aforesaid San Jacinto Avenue with the Wooster -Cedar Bayou County Road; THENCE, continuing Northerly with the centerline of the afore- said San Jacinto Avenue and its deviations approximately 1368.00 feet to an angle point, said point being identified by the Humble Refinery Coordinance System as North 12,568.00 and West 3,100.00; THENCE, North 57 degrees 42 minutes West, 605.83 feet to an angle point; THENCE, North 32 degrees 18 minutes East, 300.00 feet to an angle point; THENCE, North 57 degrees 42 minutes West 849.25 feet to an angle point; THENCE, North 32 degrees 18 minutes East 1234.27 feet to a point in the Southwesterly right- of-way line of Decker Drive, said point being identified by the Humble Refinery Coordinate System as North 14,102.27 and West 4,555.08; THENCE, Southeasterly with the Southwesterly right -of -way line of Decker Drive to the point of intersection with the Northern projection cf the West boundary line of Busch Terrace Subdivi- sion; THENCE, Southwesterly with the Northern extension of the said West boundary line of Busch Terrace Subdivision to the Northwest corner of said subdivision, and continuing Southwesterly along the West boundary line of said subdivision to the Southwest cor- ner of Busch Terrace Subdivision, and the same being the South- west corner of Long Street; THENCE, Southeasterly with the South right -o£ -way line of Long Street and the South line of Busch Terrace Subdivision to the Southeast corner of said Busch Terrace Subdivision, said corner being in the West right -of -way line of Airhart Drive; THENCE, Southwesterly with the West right -of -way line of Airhart Drive to the North right -of -way line of Lynchburg Road, said point also being a Southeast corner of the Humble Oil & Refining Company property; THENCE, Northwesterly with the North right- of-way line of the said Lynchburg Road to the West right -of -way line of Pine St.; THENCE, Southwesterly with the West right -of -way line of Pine Street over and across the Dayton -Goose Creek Railroad to the North right -of -way line of Dayton Street; THENCE, Westerly with the North right -of -way line of Dayton St. to a point in said right -of -way that is North 32 degrees 19 min- utes East a distance of 49.5 feet from the point of intersection of the West right -of -way line of Harbor Street with the North right -of -way line of Dayton Street; THENCE, South 32 degrees 19 minutes West 49.5 feet to the point of intersection of the West right -of -way line of Harbor Street with the North line of the Houston Lighting & Power Company tract in the City of Baytown, said point being the POINT OF BEGINNING of the tract herein described and being the same point of begin- ning as described in Section "B" of Ordinance No. 407 which de- fines the excluded portion of the property of said ordinance. • i Section 3: That the foregoing described additional territory and area so annexed shall be a part of the City of Baytown, and the property so added to said City shall bear its pro rata part of the taxes levied by the City of Baytown, and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens Ind shall be bound by the acts, ordinances, resolutions, regulations and provision's of the Charter of the City of Baytown. SSgction 4: That if any portion or portions of the above described property is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the re - maining territory is hereby annexed to the City of Baytown and the boundary limits ® of said City are hereby amended to conform to the boundary limits of such other cities or towns along the area of the conflict. Section 5: That if any portion or portions of the above described territory legally may become included within the limits of another city or town, by reason of a valid annexation ordinance heretofore introduced before the council, commission or other governing body of such city or town, then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boun- dary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict'. Section 6: That if any legal impediment exists preventing the valid annexa - tion of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the territory so annexed. E Section 7: If any provision, exception, section, paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of cir- cumstances or to any particular tract or parcel of 'and, shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the vali- dity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances or to other tracts or parcels of land included in the territory hereinabove described in Section 2 of this ordinance. : That this ordinance upon and after its introduction shall be pub- lished and finally acted upon in the manner provided in Article I. Section 9 of the • «50t • Charter of the City of Baytown.
