Ordinance No. 595® ORDINANCE NO. 595 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, GRANTING ALL EMPLOYEES THE SAME SICK AND INJURY LEAVES OF ABSENCE, AS PROVIDED FOR FIREMEN AND PaICEMEN IN ART- ICLE 1269m, SECTION 26, VERNON'S ANNOTATED CIVIL STATUTES; GRANTING ALL EMPLOYEES THE SAME VACATION RIGHTS PROVIDED FOR FIREMEN AND POLICEMEN IN SECTION 26(a) OF ARTICLE NO. 1269m, VERNON'S ANNOTATED CIVIL STATUTES; GRANTING ALL EMPLOYEES, EFFECTIVE OCTOBER 1, 1960, $2.00 PER MONTH FOR EACH YEAR OF SERVICE TO THE CITY OF BAYTaMs NOT TO EXCEED 5JENTY -FIVE (25) YEARS, AS PROVIDED FOR FIREMEN AND POLICE- MEN IN ARTICLE 1583 -2, PENAL CODE OF TEXAS; MAKING EXCEPTIONS AND EXCLUDING_ TEMPORARY AND SEASONAL EMPLOYEES; REPEALING CRDI- NANCES INCONSISTENT HEREWITH;-CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. • WHEREAS, the Texas Legislature adopted an Act in 1947, being Article 1269m, Vernon's Annotated Civil Statutes, generally referred to as the Firemen's andFbRicemen's Civil Service Act; and WHEREAS this Statute, when adopted by a City, gives Firemen and Police- men broad benefits and privileges not enjoyed.by other Municipal employees; and WHEREAS, the City Council.'of the City of Baytown, passed an ordinance August 28, 1952, which adopted Article 1269m, Vernon's Annotated Civil Statutes, thereby giving Firemen and Policemen these benefits and privileges; and WHEREAS, the Texas Legislature adopted a Statute in 1947, being Article 1583 -2, Penal Code of Texas, generally referred to as the Longevity for Fireman and Policemen Act, the same being self enacting, and WHEREAS, the members of the Fire and Police Departments, with the emeption of the Chiefs thereof, enjoy all of these benefits and none of the other employees enjoys such benefits; and WHEREAS, the City Council of the City of Baytown feels that all employees should enjoy the same privileges and benefits as far as possible; and WHEREAS, the City Council, at the present time, cannot afford to give all benefits to all enployees that the Texas Legislature has seen fit to give to Firemen and Policemen, but the City Council is of the opinion that it should take steps to more nearly equalize the rights and privileges of all employees, r I.,lI NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: • n • Section 1: That henceforth all employees of the City of Baytown,sha7ll, be entitled to and. shall receive and enjoy the same sick and injury leaves of absence as provided.for Firemen and Policemen in Article 1269m, Section 26, Vernon's Annotated Civil Statutes. That all employees shall be entitled to any sick leave now accumulated to their credit. Section 2: That all employees shall be entitled to the vacation rights provided for Firemen and Policemen in Section 26 (a), Article 1269m, Vernon's Annotated Civil Statutes. Section 3: That beginning October:,.l, 1960, all employees of the City of Baytown, shall be entitled to $2.00 per month for each year of service to the City of Baytown, not to exceed 25 years, as provided for Firemen and Policemen in Article 1583 -2, Penal Code of Texas. Section 4: That the terms and provisions of this ordinance shall not apply to temporary nor seasonal employees. Section 5: That the.City of Baytown may, in the future, refuse to permit new employees to become entitled to the rights and privileges set forth in-Sections 1, 2 and 3, above, but it shall never discontinue such rights and benefits as to present employees or future employees once same becomes entitled to such benefits. Section 6: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby, repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating.and governing the subject matter covered by this ordinance. Section 7: Savings Clause: If any provision, exception, section, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held uncon- stitutional, void, or invalid, such invalidity shall not effect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances, and to this end all provisions of this ordinance are declared to be severable. Section 8: Effective Date: This ordinance shall take effect immediately -2- • • from and after its passage by the City Council.
