Ordinance No. 592• • ORDINANCE NO.,_? 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PERMANENT PAVING AND OTHER IM- PROVEMENTS WITHIN THE FOLLOWING DEFINED PORTIONS OF NORTH COMMERCE STREET IN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSU- ANCE OF SPECIAL ASSESSMENT CERTIFICATES TO GULF BITHULITHIC COMPANY, THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the work of improving North Commerce Street, from the ® North property line of Forest Street to the South property line of Williams Stree- within the City of Baytown, Texas, by the construction thereupon of a cement stab ilized shell base, with asphaltic concrete wearing surface and concrete curbs and gutters and appurtenances and incidentals to such improvements as deemed neces- sary by the City Engineer, and all of said improvements being as provided for in the Plans and Specifications therefor which have heretofore been prepared by the City Engineer and as have been approved and adopted by the City Council; and all of same having been performed and completed in full accordance with all the terms and provisions of the contract dated December 10, 1959, between said City of Bay- town, Texas,and Gulf Bithulithic Company, and said City Engineer having measured, examined and caused to be tested the finished improvements by the means and in ® the manner provided by the terms of said contract and the Plans and Specification: and having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said Plans and Specifi- cations, and said City Engineer having approved and accepted said work and im- provements and having heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommended that it accept and receive said work and the improvements as constructed and completed by said Gulf Bithulithic Company, and said work and improvements having been examined and found by the Mayor and City Council of said City of Baytown, Texas, to have been performed and completed in full compliance with said contract and said ,Plans and Specifi- cations therefor, and same are hereby accepted and received by said City Council of the City of Baytown, Texas. Section 2: That the Mayor and City Clerk of the City of Baytown, Texas, are hereby authorized and directed to execute and issue to Gulf Bithulithic Com- pany, Special Assessment Certificates evidencing the assessments levied against • • tract, the City of Baytown, Texas, has agreed and dbiigated itself to issue and deliver to said Gulf Bithulithic Company, in accordance with provisions of the relative proceedings heretofore had and adopted by said City Council; said Spec- ial Assessment Certificates to be executed in the name of said City by its Mayor and City Clerk, and impressed with the seal of said City, and dated as of the date hereof, and such officers are hereby authorized and directed to execute said certificates in their official capacities on behalf of said City, and deliver same to said Gulf Bithulithic Company, said Special Assessment Certificates hav- ing heretofore been prepared and printed, a copy of which is on file with the City Clerk, the form and contents thereof being hereby approved and adopted. Section 3: This ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown.
