Ordinance No. 585• • • ORDINANCE N0. 585 AN ORDINANCE OF THE CITY COUNCIL OF THc CITY OF BAYTOWN, TEXAS, ESTABLISHING A LIBRARY DE- PARTMENT AND CREATING AN ADVISORY BOARD OF TRUSTEES TO ASSIST IN CARRYING OUT THE FUNC- TIONS AND DUTIES OF SUCH LIBRARY DEPARTMENT; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. ---- 0---0-- -0 - - -- WHEREAS, the City Charter of the City of Baytown and the Statutes of the State of Texas empower the City of Baytown, through its duly acting City • Council, to establish a Library Department and to create a Board of Trustees a five - member to assist in the functioning of such Library Department; and WHEREAS, the City Council of the City of Baytown deems it advisable to create such Department and Board, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That pursuant to the Charter of the City of Baytown, a De- partment is hereby created within the framework of the governmental organiza- tion of the City of Baytown, which shall be known as the Library Department and it shall function according to the laws of the State of Texas, and the Charter of the City of Baytown. is Section 2: There is also hereby created a five - member Advisory Board of Trustees which shall assist the proper City Officials and the Library De- partment in the operation of a Free Public Library. That the City Manager shall appoint said Trustees by and with the appro- val of the City Council. That such Trustees shall hold office for two year terms; of the first five-(5) appointments, three (3) shall be appointed for two (2) years and two (2) shall be appointed for one (1) year; and thereafter three (3) shall be appointed during even numbered years and two (2) shall be appointed during odd numbered years for said two (2) year terms. Section 3: Repealing Clause: All ordinances or parts of ordinances in- consistent with the terms of this ordinance are hereby repealed; provided, how- 0 ever, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. • Section 4: Savings Clause: If any provision, exception, section, sub - section,. paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining pro- visions of this ordinance or their application to other persons or sets of circum- stances and to this end, all provisions of this ordinance are declared to be sever- able. Section 5: Effective Date: This ordinance shall take effect from and after its passage by the City Council.
