Ordinance No. 571ORDINANCE NO. 571 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADOPTING THE TEXAS STATE REGULATIONS FDR MEAT AND POULTRY INSPECTION WITHIN THE CITY OF BAYTOWN; PROVIDING THAT ALL MEAT AND POULTRY SOLD 17ITHIN THE CITY OF BAYTOWN MUST FIRST BE INSPECTED AND APPROVED BY EITHER FEDERAL OR STATE INSPECTIONS; PROVIDING FOR ABATTOIR PERMITS; PROVIDING FOR FACILITIES FOR INSPECTION; REGULATING TRANSPORTATION OF MEAT AND POULTRY; EXEEPTING FEDERAL AND STATE ESTABLISHlldhMS; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; INCLUDING A FINE OF NOT LESS THAN TEN ($10.00) DOLLARS NOR MORE THAN TWO HUNDRED ($200.00) DOLLARS; REPEALING ORDINANCES INCONSISTEL+rT HERENITH; CONTAINING A SAVINGS LCAUSE AND PRO- VIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTO17N, TEXAS: • Section 1: Adopting State Regulations for Inspection: (a) Meat: All meat and meat products processed or sold within the City of Baytown shall be processed and regulated in accordance with the terms of "Regulations for Meat Inspection ", duly adopted and promulgated , by virtue of law, by the Commissioner of Health for the State of Texas, same being approved April, 1959, certified copies of which shall be filed in the City ClErk's Office, City Hall, Baytown, Texas. (b)-Poultry: All poultry and poultry products processed or sold within the City of Baytown shall be processed and regulated in accordance with the terms of "Regu- • lations for Poultry Inspection ", duly adopted and promulgated, by virtue of law, by the Commissioner of Health for the State of Texas, same being approved October, 1957, certified copies of which shall be filed in the City Clerk's Office, City Hall, Baytown, Texas. That said "Regulations for Meat Inspection" and "Regulations for Poultry Inspection "' as mentioned above, are attached hereto, in "Exhibit A", and are hereby made a part of this ordinance for all intents andpurposes. Section -2: ABattoir Permits: No person shall operate any abattoir or slaughterhouse within the corporate limits of the City of Baytown unless such person has been issued an abattoir permit by the Director of Health for the City of Baytown, which permit must be renewed annually on each succeeding first day of January, and may be revoked for Violation of any regulation of this ordinance. Section 3: Facilities for _Ins ectlon: It shall be unlawful in the City of Baytown for any person to have, keep, sell or expose for sale, -or to have in ,his possession with intent to sell, for human food, any poultry or poultry pro- ducts, any meat, meat products, or meat -food products derived, in whole or in part, from the meat of any cattle, sheep, swine, goats or poultry, which said meat, meat products, meat food products, poultry or poultry food products have been wholly or in part, canned, cured, smoked, salted, packed, rendered, or other- wise prepared or stored for transportation or sale, unless such meat or meat -food products, poultry or poultry -food products have been so canned, cured, smoked, salted, packed, rendered or otherwise prepared or stored for transportation or sale and inspected under the supervision of the Bureau of Animal Industry of the Department of Agriculture of the United States in accordance with the regulations of such Department, or under the supervision of the Veterinary Division of the Texas State Department of Health. Section 4: Federal and State Establishments Excepted: any official es- tablishment within the City of Baytown, at which inspection is now or hereafter maintained by the Bureau of Animal industry of the Department of Agriculture of the United States Government, under the Meat Inspection Act and other applicable laws and Federal regulations, or by the Veterinary Division of the Texas State Department of Public Health, is excepted from the provisions of this ordinance. Section.5: Transportation of-Meat Poultr or —Poultry Products: It shall be unlawful for any person to transport or cause to be transported in any vehicle through the streets or public ways of the City any meat, poultry, or poultry pro- ducts for sell within Baytown, for human consumption, unless the same is securely wrapped in paper or tightly -woven cloth covering, or cellophane bags, or unless such vehicle is provided with a tight cover, which shall be kept closed at all times during such transportation, so as not to expose the meat, poultry or poul- try products to dust, dirt, filth or other deleterious substance. Vehicles tranE porting any meat, poultry or poultry products must also be properly refrigerated to prevent same from spoiling. Section b: Penalty: Any person, firm or corporation violating any provi- sions of this ordinance or failing to observe a:iy provisions hereof shall be deemed guilty of a misdemeanor and upon conviction shall be,fined in any sum not less than Ten ($10.00) Dollars and not more than Two Hundred ($200.00) Dollars, and each and every day or fraction of a day during which this ordinance, or any part thereof, shall be violated, shall be deemed a separate offense and punish- able-as such. -2- M I. Section 7: Repealing Clause: All ordinances or parts of ordinances in- consistent with the terms of this. ordinance are hereby repealed; provided, how= ever, that such repeal shall be only to the extent of such inconsistency, and in all other respects this ordinance shall be cumulative of other ordinances re- gulating and governing the subject matter covered by this ordinance. Section 8: Savings Clause: If any provision, exception, section, subsec- tion, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held un- constitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other per- sons or sets of circumstances and to this end, all provisions of this ordinance are declared to be severable. Section 9: Effective Date: This ordinance shall take effect from and after 95 days from its passage by the City Council. The City Clerk is here- by directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
