Ordinance No. 570• J J ' • O �J 40 0 ORDINANCE NO. 570 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTONN, TEXAS, RECEIVING AND ACCEPTING THE NORIC OF CONSTRUCTION OF PERMANENT PAVING AND OTHER Ii.I- PROVER4ENTS WITHIN THE FOLLO11ING DEFINED PORTIONS OF NORTH AND SOUTH MAIN STREET IN THE CITY OF BAY - TOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSAENT CERTIFICATES TO BROWN & ROOT, INC., THE CONTRACTOR PERFORMING, SAID WORK; APPROVING THE FORIN OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE CITY OF BAYTOWN: IT ORDAINED BY THE CITY COUNCIL OF THE Section 1: That the work of improving North and South Alain Street from the South property line of Fayle Street to the North right -of -way line of Cedar Bayou Road, within the City of Baytown, Texas, by raising, grading, filling, widening, permanently paving and repaving same, and by the construction, reconstruction, re- pairing and realigning of concrete curbs and gutters, and by the construction of such drains and other necessary incidentals and appurtenances as deemed necessary by the City Engineer, said permanent paving consisting of reinforced concrete pave- ment upon a properly prepared subgrade, of such type, construction, materials and thickness as deemed adequate and suitable by the City Engineer, and all of said im- provements being as provided for in the Plans and Specifications therefor which have heretofore been prepared by the City Engineer and as have been approved and adopted by the City Council; and all of same having been performed and completed in full ac- cordance with all the terms and provisions of the contract dated February 26, 1959, between said City of Baytown, Texas and Brown G Root, Inc., and said City Engineer having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of said contract and the Plans and Specifications, and having found that such improvements have been constructed and completed in full compliance with all provisions of said contract and said Plans and Specifications, and said City Engineer having approved and accepted said work and improvements and having heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommended that it accept and receive said work and the improvements as constructed and completed by said Brown & Root, Inc., and said work and improvements having been examined and found by the Mayor and City Council of said City of Baytown, Texas, to have been performed and complete, 1 • 0 in full compliance with said contract and said Plans and Specifications therefor, and are hereby accepted and received by said City Council of the City of Baytown, Texas. Section 2: That the Mayor and City Clerk of the City of Baytown, Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc., Special Assessment Certificates evidencing the assessments levied against the properties ir.:proved abutting upon said portions of forth and South Plain Street and against the real and true owners thereof, which, by the terms of said contract, the City of Bay- town, Texas, has agreed and obligated itself to issue and deliver to said Brown & Root, Inc., in accordance with provisions of the relative proceedings heretofore had and adopted by said City Council; said Special Assessment Certificates to be -1 executed in the name of said City by its ilayor and City Clerk, and impressed with the seal of said City, and dated as of the date hereof, and such officers are here- by authorized and directed to execute said certificates in their official capacities on behalf of said City, and deliver same to said Brown & Root, Inc., said Special Assessment Certificates having heretofore been prepared and printed, a copy of which is on file with the City Clerk, the form and contents thereof being hereby approved and adopted. Section 3: This ordinance shall take effect from and after the date of its passage by a majority of the City Council of the City of Baytown.
