ORDINANCE NO. 530
AN ORDINANCE RECEIVING AND ACCEPTING THE UORK CF
CONSTRUCTION OF PERjJANENT PAVING AND OTHER IMPROV E-
iOIENTS IVITHI14 THE FOLLOWING DEFINED PORTIONS OF WIL-
LIAMS STREET IN THE CITY OF BAYTOWN; AUTHORIZING
AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL
ASSESSMENT CERTIFICATES TO GULF BITHULITHIC COI.IPANY,
THE CONTRACTOR PERFORMING SAID 1'IORK; APPROVING THE
FORM OF SUCH SPECIAL ASSESSMEA CERTIFICATES; AND
PROVIDING FOR THE EFFECTIVE DATE HMEOF,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTONN:
Section 1; That the work of improving 11illiams Street, from the East
property line of Pruett Street to the West property line of North Main Street
(formerly Goose Creek Street) within the City of Baytown, Texas, by raising,
grading, filling, widening, permanently paving and repaving same, and by the
construction, reconstruction, repairing or realigning of concrete curbs and
gutters, and by the construction of such drains and other necessary inciden-
tals and appurtenances as deemed necessary by the City Engineer, said perman-
ent paving consisting of an adequate asphaltic wearing surface upon a substan-
tial concrete base, both of such type, construction, materials and thickness
as have been deemed adequate and proper by said City Engineer, and all of said
improvements being as provided for in the Plans and Specifications therefor
which have heretofore been prepared by the City Engineer and as-have been ap-
proved and adopted by the City Council; and all of same having been performed
and completed in full accordance with all the terms and provisions of the con-
tract dated August 28, 1958, between said City of Baytown, Texas and Gulf Bithu-
lithic Company; and said City Engineer having measured, examined and caused to
be tested the finished improvements by the means and in the manner provided by
the terms of said contract and the Plans and Specifications, and having found
that such improvements have been constructed and completed in full compliance
with all provisions of said contract and said Plans and Specifications, and
said City Engineer having approved and accepted said work and improvements
and having heretofore issued his Certificate of Final Acceptance, and so certi-
fied to said City Council and recommended that it accept and receive said work
and the improvements as constructed and completed by said Gulf Bithulithic Com-
pany, and said work and improvements having been examined and found by the Mayor
and City Council of said City of Baytown, Texas, to have been performed and
completed in full compliance with said contract and said Plans and Specifica-
tions therefor, said work and improvements are hereby found by said City Coun-
cil to have been performed and completed by said Gulf Bithulithic Company, in
full compliance with the terms and provisions of said contract and said Plans
and Specifications therefor, and same are hereby accepted and received by said
City Council of the City of Baytown, Texas.
Section 2: That the mayor and City Clerk of the City of Baytown, Texas,
are hereby authorized and directed to execute and issue to Gulf Bithulithic
Company, Special Assessment Certificates evidencing the assessments levied
against the properties improved abutting upon said portions of Villiams Street
and against the real and true owners thereof, which, by the terms of said con-
tract, the City of Baytown, Texas, has agreed and obligated itself to issue and
deliver to said Gulf Bithulithic Company, in accordance with provisions of the
relative proceedings heretofore had and adopted by said City Council; said
Special Assessment Certificates to be executed in the name of said City by its
flavor and City Clerk, and impressed with the seal of said City, and dated as of
the date hereof, and such officers are hereby authorized and directed to exe-
cute said certificates in their official capacities on behalf of said City, and
deliver same to said Gulf Bithulithic Company, said Special Assessment Certifi-
cates having heretofore been prepared and printed, a copy of which is on file
with the City Clerk, the form and contents thereof being hereby approved and
adopted.
Section 3: This ordinance shall take effect from and after the date of
its passage by a majority of the City Council of the City of Baytown.
INTRODUCED, BEAD and PASSED by a majority of the City Council of the City
of Baytown, Texas, on this the 15th day of April, 1959.
