AN ORDINANCE APPROPRIATING THE SUM OF $925.00
OUT OF THE STREET AND DRAINAGE BOND FUND, SERIES
1958, TO PAY THE COST OF CURBS, GUTTERS, AND
PAVING TO BE CONSTRUCTED BY THE CITY'S CONTRACTOR
IN FRONT OF CERTAIN PARCELS OF PROPERTY ABUTTING
UPON HAWTH05NE AND BURBANK STREETS BETWEEN THE
EAST PROPERTY LINE OF BARRYMORE BLVD. AND THE
WEST PROPERTY LINE OF CARNEGIE STREET, BAYTOWN,
TEXAS, WHICH PARCELS OF PROPERTY APPEAR TO BE
EXEMPT FROM ASSESSMENTS; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, the Director of Fanance has certified to the City
Council that there is in his hands in the above fund, available
for appropriation, a sum sufficient for the purpose here below
i stated: NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: There is hereby appropriated out of the Street
and Drainage Bond Fund, Series 1958, the sum of $925.00 to pay
the cost of curbs, gutters, and paving to be constructed by Gulf
Bitulithic Company under a contract dated November 13, 1958, be-
tween said Company and the City of Baytown in front of the following
parcels of property abutting upon Hawthorne and Burbank Streets
between the East property line of Barrymore Blvd. and the West
property line of Carnegie Street, in Baytown, Texas, which parcels
of property appear to be exempt from assessments for such improve-
ments and to be owned by parties who have failed or refused to
secure the City's contractor in the payment of the assessments
levied in connection with said improvements, namely:

and the City of Baytown hereby agrees to pay the foregoing amount
to Gulf Bitulithic Company upon completion of said improvements by
said contractor and acceptance thereof by the City of Baytown, and
the Mayor and the Director of Finance are hereby authorized to
draw a warrant in said amount, or so much thereof as may be
necessary, against said fund to pay and discharge the obligations
of the City of Baytown chargeable thereto. Said fund is the
lawful and proper fund out of which this appropriation can be
paid, and this appropriation is made pursuant to a proper certi-
ficate of the Director of Finance.
Section 2: This Ordinance shall take effect from and after
the date of its passage by a majority of the City Council of the
City of Baytown.
Introduced, read, and passed by a majority of the City
Council of the City of Baytown on this 26th day of March, 1959.
