Ordinance No. 519• LJ 0 • ORDINANCE N0. 519 AN ORDINANCE REQUESTING THE COMPTROLLER OF PUBLIC ACCOUNTS OF THE STATE OF TEXAS TO CANCEL REVENUE BOND IN HIS POSSESSION; CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT FROMAND AFTER ITS ADOPTION WHEREAS, the City Council of the City of Baytown, Texas, adopted ordinances on the 13th day of May, 1957, and the 23rd day of May, 1957, authorizing the issuance of the $465,000 CITY OF BAYTOWN WATERWORKS AND SEWER SYSTEM REVENUE REFUNDING BONDS, SERIES 1957, dated May 15, 1957, numbered consecutively from 1 through 465, in the denomination of $1,000, aggregating $465,000, and maturing' - serially in their numerical order on the 15th day of May in each of.the years 1958 through 1967, which bonds were approved by the Attorney General of the State of Texas on the 6th day of June, 1957, and registered by the Comptroller of Public Accounts of the State of Texas under Register No. 31865; and WHEREAS, all $465,000 underlying revenue bonds to be re- funded by the issuance of said Series 1957 revenue refunding bonds have been presented to and canceled by the said Comp- troller with the exception of Bond No. 30, in the denomination of $1,000, of the Harris County Water Control & Improvement District No. 7 Waterworks and Sewer System Revenue Bonds, Series 1945A, dated September 1, 1945; and WHEREAS, it was provided in the said ordinance adopted May 23, 1957, that said Bond No. 30 would be exchanged for Bond No. 137 of said Series 1957 revenue refunding bonds; and WHEREAS, the said Comptroller has registered and released all bonds of said Series 1957 revenue refunding bonds except said Bond No. 137; and 0 r, I L • • WHEREAS, said underlying Bond No. 30 was recently pre- sented to the City, and.said City had surplus funds, and I determined to pay off, discharge, and cancel said Bond No. 30 rather than have the same exchanged for Bond No. 137 of said Series 1957 revenue refunding.bonds; and WHEREAS, said Bond No. 30'has now been paid and canceled, and said Bond No'.-137 of. the Series 1.957 revenue refunding bonds will never be exchanged and issued; and WHEREAS, the.City Council wishes to,instruct the Comptroller of Public Accounts of the State of Texas-to cancel said Bond No. 137; Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That a certified copy of this ordinance, to- gether with canceled Bond No. 30 of the Harris County Water Control & Improvement bistrict No. 7 Waterworks and Sewer System Revenue Bonds, Series 1945A, dated September 11 1945, shall be furnished the Attorney General of the State of Texas, and such certified copy of this ordinance will constitute a request to the Attorney deneral that he instruct the Comptroller of Public Accounts of the State of Texas to cancel Bond No. 137 of ,the City of Baytown Waterworks and Sewer System Revenue Refunding Bonds, Series 1957, dated May -15, 1957. Section 2: It is• further requested that such certified copy of this ordinance be placed in the transcript of pro- ceedings on file in the,office of said Comptroller under Regis- ter No. 31865, and that the Attorney',General return said can- celed Bond No. 30 to-the City of Baytown.
