Ordinance No. 501-AIs ORDINANCE NO. 501 -A AN ORDINANCE CONTAINING ORDINANCE NO. 501, INTRODUCED THE 10TH DAY OF JULY, 1958, AND BEING "AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS , AND ANNEXING ADDITIONAL ADJACENT TER- RITORY OF SAID CITY, ALL OF IIHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUB- LICATION AND PASSAGE OF THIS ORDINANCE IN THE MANNER PRO- VIDED IN ARTICLE 1, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN "; PROVIDING FOR THE MENDMNT OF SAID ORDINANCE RHO. 501 WITH RESPECT TO THE TERRITORY TO BE ANNEXED AND FOR THE FINAL PASSAGE OF SAID ORDINANCE IN AP-ENDED FORM PURSUANT TO SECTION 9, ARTICLE I, OF THE CHARTER OF THE CITY OF BAYTOWN: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: ® Section 1: That pursuant to Section 9, Article I, of the City Charter, said Ordinance No. 501, introduced in the City Council of the City of Baytown, on the 10th day of July, 1958, shall be amended and so amended shall read as follows: "ORDINANCE NO. 501 AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOwN, TEXAS, AND ANNEXING ADDITIONAL ADJACENT TERRITORY OF SAID CITY, ALL OF I'JHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND PASS- AGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ART- ICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAY - TOl'',!N : ® BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOIVN : Section 1: INTENT AND PURPOSE OF THIS ORDINANCE: The City Council of the City of Baytown, acting pursuant to Section 9, Article I, of the Charter of said City, hereby declares that it is necessary that the existing boundary limits of the City be extended to include such territory. The purpose and intent of this -extension of the boundary limits of the City of Baytown is to take care of said City's present needs for additional territory and the reasonably anticipated fu- ture growth and expansion of the City. Section 2: That the boundary limits of the City of Baytown, Texas, be en- larged and extended as hereinafter set out so as to include within the boundary ® limits of said City, all that territory adjacent to said City within the follow- described lines, to -wit: BEGINNING at the intersection of the South right- of-way line of a 60 foot wide road right -of -way as recorded in Volume 3127, Page 643 in the Deed Records and the West right-of-way of North Main Street, said point being North 1 degree 2 minutes East 635.6 feet from the Southeast corner of the said 210.6 acre tract and said point being the Northeast corner of the tract herein described; THENCE, blest 3,429.09 feet to the Northwest corner of the tract herein described; THENCE, South 13 degrees 10 minutes West 31.05 feet to a corner; THENCE, South 67.60 feet to a corner; THENCE, South 69 degrees 45 minutes East 96.44 feet to a corner; THENCE, South 484.0 feet to the Southwest corner of the tract herein described, said point being 800 feet East of the East right -of -way of Garth Road and said point ® being ,on the South line of the aforementioned Aron 210.6 acre tract; THENCE, East with the South line of the aforementioned 210.6 acre tract 2,608.41 feet to the most Southerly Southeast corner of the tract herein described, said point being also the Southwest corner of a 5.0 acre tract of the Texas National Guard Armory as described in deed recorded in Volume 2707, Page 467 of the Deed Records; THENCE, North with the blest line of the said 5.0 acre Armory tract 555.2 feet to a corner, said point being also the Northwest corner of the said 5.0 acre Armory tract; THENCE, East 392.29 feet along the North line of the said 5.0 acre Armory tract to a corner, said point being the Northeast corner of said Armory tract; THENCE, South along the East line of said Armory tract 60 feet for a corner; ® THENCE, East 342.54 feet to a corner, said point being in the l':fest right -of -way of North Main Street; THENCE, North 1 degree 2 minutes East with the Vest right - of -way of said North 'fJain Street, 140.4 feet to the North- east corner and POINT OF BEGINNING of the tract herein described. Section 3: That the foregoing described additional territory and area so annexed shall be part of the City of Baytown, and the property so added to said City shall bear its pro rata part of the taxes levied by the City of Baytown, and the inhabitants thereof shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, re- gulations and provisions of the Charter of the City of Baytown. ® Section 4: That if any portion or portions of the above described property is validly included within the territory limits of another city or town, then such portion or portions of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary -2- 7 limits of said City are hereby annexed to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section 5: That if any portion or portions of the above described territory legally may become included within the limits of another City or Town by reason of a valid annexation ordinance heretofore introduced before the Council, Commis- sion or other governing body of such city or town, then such portion or portions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section b. That if any legal impediment exists preventing the valid annexa- tion of any portion of the above described.territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remain- ing territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the territory so annexed. Section 7: If any provision, exception, section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances or to any particular tract or parcel of land, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other tracts of land included in the territory hereinabove described in Section 2 of this ordinance Section 8: That this ordinance upon and after its introduction shall be ® published and finally acted upon in the manner provided in Article -I, Section 9, of the Charter of the City of Baytown, on this 30th day of December, 1958. w R.
