Ordinance No. 5000 �J ;s J " ORDINANCE I`0. 500 AN ORDINANCE ENL,ItGiNG Ah'D EXTENDING THE BOUNDARY LIMITS OF THE CITY OF .BAYTOPIN, TEXAS, AND ANNEX- ING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, • ALL OF 1 11CH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PnOVMING FOR THE PUBLICATION AND PASSAGE OF THIS ORDINANCE IN THE I-TANNER PRO - V-IDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYT017N. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOVJW- Section 1: Intent And Purpose Of The Ordinance. The City Council of the City of Baytown, acting pursuant to Article I, Section 9, of the Charter of said City; hereby declares that it is necessary that the hereinafter described terri- tory lying adjacent to the City be annexed and the existing boundary limits of the City be extended to include such territory. The purpose and intent of this .d extension of the boundary limits of the City of Baytown is to take care of said City's present needs for additional territory and the reasonably anticipated fu- ture growth and expansion of the City. Section _2: That the boundary limits of the City of Baytown, Texas, he en- larged and extended as hereinafter set out so as to include within the boundary limits of said City all that territory lying adjacent to said City within the fol- lowing described lines, to -wit: BEGINNING at the point of intersection of the West line of Ashbel Smith / -Vhe East line of Annie Wright Tract, the Northerly line of San Jacinto Bay, the same being South 09 degrees 40 minuses East 35% varas (990.27 ft.) from the Southwest corner of william Scott Lower Leaguo; THENCE, North 50 degrees 30 minutes'East, and along the East line of the Annie iiright Tract, to an old fence row, 1370.8 feet to corner; THENCE, North 52 degrees hest, with the fence rote in the Annie t1right Tract line, 343 feet to corner, being an intra corner of this Tract; THENCE, with the East line of the Annie Uright tract, North 19 degrees 11 minutes East, to a point situated South 19 de- grees 11 minutes West 620 feet from the Northeast corner of the Annie Wright Tract, and said point further described as situated South 19 degrees 11 ninutes Vest 1302.41 feet from the Southerly right -of -way line of State Highway 146; THENCE, over and across the Ashbel Smith Land Company Tract, North 07 degrees 09 minutes 06 seconds East, 8613.14 feet to corner, said corner being an iron axle in the centerline of Pine Gully at its point of confluence with the Pest line of Cedar Bayou Stream, and said corner being the Southeast cor- ner of Ashbel Smith Land Company Tract; and corner being fur- ther described as the Northeast corner of the tract awarded the Defendants in Cause No. 33763 - Jessie K. Humason, et al -vs- Thomas B. Kittredge, et al, by the 61st District Court -of Harris County, Texas; "211 ® THENCE, South 35 dery =•ees 20 minutes Pest, ebbing the !'festern line of the land allotted to Defendants in said Cause above, 2692 varas (7338.8 ft.) more or less to the North bank of San Jacinto Bay, being the Southwest corner of the land allotted to said Defendants, and the Southwest corner of the tract al- loted to the Plaintiff in said Cause; THENCE, Westerly along the bank of said San Jacinto Bay with its meanders to the PLACE OF BEGINNING. Section 3: That the above described additional territory and area so annexed shall be a part of the City of BaytoWl, and the property so added to said City shall bear its prc rata part of the taxes levied by the City of Bay- town and the inhabitants thereof shall be entitled to all the rights and privi- leges of all the citizens and shall be bound by the acts,-ordinances, regula- tions and provisions of the Charter of the City of Baytown. Section 9: That if any portion or portions of the above described terri- tory is validly included within the territory limits of another city or town, then such portion'or portions of the above described territory is hereby ex- cluded and the remaining territory is hereby annexed to the City of Baytown, and the boundary limits of said city are hereby amended to conform to the boun- dary limits of such other city or town or such other cities or towns along the area of the conflict. Section 5: That if any portion or portions of the above described terri- tory may become included within the limits of another city or town, by reason ® of a valid ann-nxation ordin��nce heretofore introduced before the Council, Com- mission or other governing body of such city or town, then such portion or por- tions of the above described territory is hereby excluded from the limits of the City of Baytown and the remaining territory is hereby annexed to the City of Baytown and the boundary limits of said City of Baytown are hereby amended to conform to the boundary limits of such other city or town or such other cities or towns along the area of the conflict. Section 6: That if any legal impediment exists preventing the valid an- nexation of any portion of the above described territory to the City of Baytown, then such portion of the above described territory is hereby excluded and the remaining territory is hereby annexed to the City of Baytown and the boundary ® limits of said City of Baytown are hereby amended to conform to the territory so annexed. ,t3�� Section , 7: If any provision, exception, section, paragraph, sentence,. clause or phrase of this ordinance or-the application of same to any person or set of circumstances or to any particular tract or parcel of land, shall for any reason be he?d unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaii;ng provisions of this ordinance or their ap- plication to other persons or sets of circumstances or to other tracts or par- cels of land included in the territory hereinabove described in Section 2 of this ordinance. Section 8: That this ordinance upon and after its introduction shall be published and finally acted upon in the manner provided in Article I, Section 9, ® of the Charter of the City of Baytown.
